REMINDER: FLORIDA IS A NO FAULT STATE. In some states, “fault” is established as one of the grounds for divorce, but Florida abolished fault as a grounds for divorce, hoping to reduce the potential harm to the parties and the children from the divorce pleadings. Specifying the exact reason for a divorce is no longer necessary. The marriage must simply be “irretrievably broken” for a divorce case to be filed. Mediation is a simple, low-stress alternative to litigation. This alternative dispute resolution process is being used with increasing frequency because it is a humane way of resolving issues and is less antagonistic and much less stressful than litigation. is a process that involves the assistance of a neutral third party called a mediator. DOES FLORIDA LAW ALLOW SURROGACY?
Yes. Gestational surrogacy is codified into Florida law. Pre-planned adoption agreements in the case of generic or traditional surrogacy are also allowed by law. Q: Do I need to file for separation before divorce?
A: No! There is no such thing as legal separation in Florida. The Florida law does not require a legal separation prior to seeking a divorce. Other states require you separate before filing for divorce. That’s not the case for Florida.
