Not sure if this verdict will hold up, as the defense is very well represented by ; however, people should understand the difference between a fountain on premises controlled by the premises owner versus ice in a parking lot or some such. Property owners do not generally have a duty to prevent the dangers of ice in a parking lot, but these facts appear to be different. I was not part of either side, but think the clarification is important. I will say this is a verdict involving two very good Dallas firms who were very well versed with Dallas County juries.
