When a small insurance claim is denied, most homeowners simply walk away.

But a recent Texas appellate victory shows why some fights are worth taking.

Johnston Tobey Baruch shareholder Chad Baruch successfully represented two Texas homeowners on appeal in a case involving a denied water damage claim against the Texas FAIR Plan Association.

In coverage by WFAA, Chad discussed the decision from the Fifth District Court of Appeals of Texas at Dallas, which affirmed that the homeowners were entitled to recover their attorneys’ fees after years of litigation.

At issue was whether the jury’s damages award accounted for the homeowners’ insurance deductible, a detail that ultimately determined whether they had “won” the case under Texas law.

The ruling reinforces that insurers must clearly raise deductible-related arguments during trial and may give homeowners more confidence to challenge denied claims.

This month, our firm wanted to take a moment to celebrate Black History Month by spotlighting a case that advanced civil rights and demonstrated the transformative power of appellate advocacy.

In Brown v. Board of Education, the United States Supreme Court unanimously held in 1954 that racial segregation in public schools violated the Equal Protection Clause of the Fourteenth Amendment. With that decision, the Court overturned decades of precedent and rejected the doctrine of “separate but equal” in public education.

At Johnston Tobey Baruch, we believe the appellate process serves a vital role in safeguarding rights and ensuring accountability. This Black History Month, we honor the courage of the families and advocates who pursued equality through the courts.
