The Law Office of Nina S. McDonald, PLLC is officially closed. My family is moving to the Seattle area in June, and Texas attorneys need to be in Texas to practice in Texas. It was a pleasure serving my past clients and helping give them a peace of mind about the future. Best wishes to everyone!

Good news! Yesterday, Governor Abbott made it possible to sign estate plans with a licensed notary public in Texas via video conference.

On April 9, 2020, Governor Abbott temporarily suspended Texas laws requiring certain documents be notarized in person, including wills, powers of attorney, and medical directives. This means that, under most circumstances, estate plans can be finalized, signed, and notarized by video conference as long as:

1) You have access to a scanner and printer and
2) For the signing of documents requiring witnesses (which includes wills), you are comfortable with having two witnesses in the same room as you.

The witnesses can be 6 feet apart, but they must both be in the same room as you to physically see you sign your documents. Some estate planning documents do not require witnesses.

As always, I recommend you create and finalize an estate plan with a Texas licensed attorney. The temporary suspension of the in-person notarization requirement makes finalizing and signing your estate plan easier through the COVID-19 pandemic.
