Probate documents can often feel confusing, especially when terms like “independent administration” are involved.

In Texas, independent administration allows an estate to be handled with minimal court involvement, making the process faster and more efficient.

Here’s what it means for families:

Less court supervision during probate
Faster handling of estate matters
Executor can manage assets and distributions
Reduced delays and administrative costs

Many families are asked to sign consent and waiver documents, which can feel overwhelming without proper understanding.

Knowing what these terms mean can help you make informed decisions and avoid unnecessary stress during the probate process.

At The Blacknall Firm, we help families navigate probate with clarity and confidence.

Probate can be confusing, especially when you’re unsure which assets actually go through the process.

In Texas, not all assets require probate and understanding the difference can help avoid delays and unnecessary stress.

Here’s what determines if an asset goes through probate:

Assets owned solely in the deceased person’s name
Presence (or absence) of beneficiary designations
Joint ownership structures
Trust arrangements

Some assets transfer automatically, while others require court involvement to change ownership. Most estates include a mix of both.

Knowing this early can help families plan better and avoid complications during the process.

At The Blacknall Firm, we help families navigate probate with clarity and confidence.

A family is sorting through paperwork after a loved one passes away. They find a house, a bank account, a retirement account, and a life insurance policy. Someone asks: “Do all of these go through probate?” No one is sure. They were told probate might be required, but now they

Probate is often one of the first legal steps families face after losing a loved one—but how long does it actually take?

In Texas, most probate cases take between 6 to 12 months. However, timelines can vary depending on several factors.

Here’s what affects the probate process:
Complexity of estate assets
Cooperation between beneficiaries
Availability of financial records
Court scheduling timelines
Outstanding debts or disputes

Probate involves multiple stages, including filing the application, court approval, notifying creditors, and distributing assets. Delays at any step can extend the timeline.

With proper guidance and early action, many delays can be avoided and the process can move more efficiently.

At The Blacknall Firm, we help families navigate probate with clarity, ensuring every step is handled correctly and without unnecessary delays.

Many families assume that having a will means probate isn’t required. In Texas, that’s usually not the case.

A will outlines your wishes, but probate is the legal process that gives an executor the authority to act on those wishes.

Here’s when probate is typically required:
Property is held solely in the deceased’s name
Bank accounts don’t have named beneficiaries
Real estate needs to be transferred or sold
Creditors need to be notified and settled

In most cases, banks and title companies will not release assets without probate court approval.

However, some assets may avoid probate, such as:
Life insurance with named beneficiaries
Retirement accounts
Payable-on-death accounts
Assets held in a trust

Understanding the difference can help you avoid delays and confusion during an already difficult time.

At The Blacknall Firm, we help families navigate probate efficiently and ensure estates are handled correctly from start to finish.

Ever sacrificed your peace of mind just to avoid a fight?

Sunday Snippet: The Let Them Theory
I recently finished The Let Them Theory by Mel Robbins.

It’s a simple mindset shift.

But it changes everything.

The core idea?

Let them.

Let them have their own opinions.
Let them make their own choices.
Let them walk their own path.
Instead of wasting energy trying to control people… you let go.

The best part?

That’s only half of it.

The second part is just as important:

Let me.

Let me focus on what I can control.
Let me set my own priorities.
Let me choose what’s best for my future.
This isn’t passive.

It’s powerful.

Because the moment you stop managing others… you reclaim your energy.

And that energy?

Goes back to you.

Your growth.
Your peace.
Your next chapter.

The challenge?

Sometimes you’ll see someone making a choice that concerns you.

If you have a close relationship, offer your advice.

If they take it, great.

If they don’t?

Let them.

Because people only change when they are ready.

Trying to force them won’t work.

It only drains you.

And if you keep holding onto someone’s potential instead of their reality…

You’ll miss what’s right in front of you.

This book is a must-read for anyone going through big life changes—especially divorce.

Because sometimes the best thing you can do is simple.

Let them.

And move forward.

Have you read it? Would love to hear your thoughts.

𝗬𝗼𝘂𝗿 𝗱𝗶𝘃𝗼𝗿𝗰𝗲 𝗼𝘂𝘁𝗰𝗼𝗺𝗲 𝗶𝘀𝗻’𝘁 𝗺𝗲𝗮𝘀𝘂𝗿𝗲𝗱 𝗯𝘆 𝘄𝗵𝗼 𝗴𝗲𝘁𝘀 𝘁𝗵𝗲 𝗵𝗼𝘂𝘀𝗲.

Or who keeps the investments.

Or who wins the argument.

Or who walks away first.

Those things only matter if they help you build a better future.

The people who move forward after divorce?

They're making decisions that serve their future, not trap them in the past.

Intentional choices. Thoughtful strategy.

No more:

Fighting over things that don’t matter
Letting anger make the decisions
Seeking validation through “winning”
Sacrificing peace for control
Just the freedom to build a life that works for you.

Want to make informed decisions instead of emotional ones?

Divorce doesn’t define your future.
The strongest people?

They know how to turn conflict into clarity.

You can’t control every outcome.

But you can control:

How you respond to it
How you protect your priorities through it
How you rebuild after it
The hardest work isn’t running from change.

It’s choosing to face it with clarity.

And using it to build the life you actually want.

That’s what separates reaction from strategy.

That’s what turns endings into new beginnings.

Want to make informed decisions about your next steps?

How to increase your stability during divorce:

-Plan more
-Set boundaries more
-Stay focused more
-Respond thoughtfully more
-Let go more

Stability often comes from putting in more reps at these things.

𝗜 𝗱𝗼𝗻’𝘁 𝘄𝗮𝗻𝘁 𝗮 𝗱𝗶𝘃𝗼𝗿𝗰𝗲 𝘁𝗵𝗮𝘁 𝘁𝗮𝗸𝗲𝘀 𝗼𝘃𝗲𝗿 𝗺𝘆 𝗹𝗶𝗳𝗲.Some people think that’s impossible. But they’re focused on the wrong thin...

𝗜 𝗱𝗼𝗻’𝘁 𝘄𝗮𝗻𝘁 𝗮 𝗱𝗶𝘃𝗼𝗿𝗰𝗲 𝘁𝗵𝗮𝘁 𝘁𝗮𝗸𝗲𝘀 𝗼𝘃𝗲𝗿 𝗺𝘆 𝗹𝗶𝗳𝗲.

Some people think that’s impossible.

But they’re focused on the wrong things:

Winning every argument
Dragging things out to prove a point
Letting a judge make the final call
People who divorce well take a different approach:

They prioritize their long-term stability over short-term battles.
They focus on solutions that keep them in control of their future.
They make decisions that protect their careers, children, and financial well-being.
This isn’t about backing down. It’s about taking control.

The problem?

Nobody teaches successful professionals how to navigate divorce without letting it consume them.

Colleagues tell you to “lawyer up.”
Friends say, “Make them pay.”
And the court? It treats your life like a case number.

So people get stuck in unnecessary conflict, burning time and energy that could be spent moving forward.

Here’s the truth about divorce:

You don’t have to let it disrupt your career.
You don’t have to let it control your schedule.
You don’t have to lose sight of what matters.
You need a plan, not a battle.

If you want clarity on your options, my consultations aren’t sales calls. They’re strategy sessions.
