Nurses (and other healthcare providers) in the U.S. have a legal and ethical duty NOT to assist with detaining immigrants who have sought healthcare. A patient who is an immigrant has a right to privacy and confidentiality like any other patient. Further, it is NOT within the scope of an individual nurse's knowledge, experience, or expertise to decide if a document presented is a valid and enforceable warrant so if ICE or law enforcement shows up at a hospital, nurses should refer them to the hospital's legal department. And hospitals have a duty to protect their employees. If you know of a nurse who is arrested in Texas for protecting their patient, please contact me at 214-810-1867. https://www.nursingworld.org/practice-policy/nursing-excellence/ethics/code-of-ethics-for-nurses/
The Code of Ethics for Nurses with Interpretive Statements, updated in 2015, is the profession's non-negotiable ethical standard.
