This is the question that keeps parents up at night, and the one most of us avoid: if something happened to you tomorrow, who would raise your children? โค๏ธ

Most parents have an answer in their heads. Grandma. My best friend. My brother.

But an answer in your head isn't a plan.

If you haven't legally named guardians for your minor children, a Texas court decides who raises them. A judge who has never met your kids, never heard their laugh, and doesn't know which relative they adore or which one they barely know.

And there's a piece most parents never think about: the hours and days right after something happens. Who has the authority to step in immediately? Who picks them up from school? Who do the babysitter and the hospital call?

Danelle and I believe a family should never have to guess. That's why we help parents name both long-term and short-term guardians, back them up with alternates, and leave clear instructions so the people caring for your children know them the way you do.

Your kids are your greatest legacy. Let's make sure they're protected by the people you choose.

Did you know? Texas is probate-friendly. But it is not probate-free. ๐Ÿค

Here's what we hear all the time: "I have a will, so my family won't have to deal with court."

Not quite.

Texas does make probate simpler than many states. But a will still has to go through the court before it does anything. That means filings, a hearing, a public record anyone can look up, and time. Often months. Sometimes longer.

Meanwhile, the people you love are grieving, the bills keep coming, and accounts may be frozen until the court gives someone authority to act.

A document is not a plan.

A plan is built for your family as it is today: your home, your business, your marriage, your children. It's designed to keep your family out of court, out of conflict, and out of the public eye.

Let's settle the great debate: Team Will or Team Trust? ๐Ÿ“œโš–๏ธ

Here's the scouting report.

๐Ÿ“œ Team Will
A will tells the court what you want. It's the simpler document to create, and it's where you name guardians for minor children. But a will doesn't avoid probate. Your family still goes through the court process, it becomes public record, and they wait.

โš–๏ธ Team Trust
A revocable living trust holds your assets during your life and passes them privately after. When it's properly funded, your family can skip probate entirely. The catch: a trust only works if your assets are actually in it. An empty trust is just expensive paper.

๐Ÿ† So who wins?
Honestly, most families need players from both teams. A trust to keep things private and out of court. A will to name guardians and catch anything left outside the trust.

But the real winner is Team Family. The right plan is built around the people you love, not a one-size-fits-all form.

So, which team are you on today? Comment WILL or TRUST. And if your answer is "I have no idea," that's exactly where Danelle and I love to start.

Tomorrow kicks off National Estate Planning Awareness Week, and Danelle and I are spending all seven days on the conversations most families put off.

Wills vs. trusts. Texas probate. Who would raise your kids. Blended families. The mistakes smart people make. And why your legacy is so much more than money.

No dry legal lectures. Just honest, real-life talk about protecting the people you love.

Follow along all week. โค๏ธ

Your Legacy. Their Future. Team Family. Always. โš–๏ธ

"My children get what is left" is not the same as "my children get $400,000."

Suppose you have $800,000 meant to support your spouse and eventually benefit your children. Your spouse could need that support for another 25 years. If your trust allows the original funds, not just the income they earn, to pay for that support, the remainder can shrink. Naming your children as the eventual recipients doesn't guarantee how much they receive.

That doesn't make the trust wrong. It makes the terms and funding worth understanding.

You can decide whether your children should receive a defined amount, a percentage, or whatever remains. Some families fund the two goals separately, including through properly structured life insurance. I want you to know which promise your plan actually makes.

Exceptional legal service begins with genuine human connection, and Sabrina Burton embodies that.

I'm delighted to introduce Sabrina, our Director of Legal Operations & Client Services. She brings more than 30 years of experience in the legal profession, and she helps coordinate our legal operations, supports our attorneys, and makes sure our clients receive the attention, respect, and personal service they deserve. She brings warmth, dedication, and a welcoming presence to our office.

You may have noticed the teal butterfly in our new logo. That one is Sabrina's. Teal is her color because of her love of turquoise jewelry, a personal touch that reflects her appreciation for beauty and individuality. And like a butterfly, she reminds us that every new chapter brings room for growth.

Come say hello.

Q: If I leave everything to my spouse, will my children inherit it later?

A: I'd ask you a question first: do you mean a specific inheritance, or whatever remains after your spouse's needs are met? Those are different promises.

If you leave assets outright, your spouse generally owns them, subject to enforceable arrangements and other legal restrictions. Your original hopes don't automatically control what happens next. That isn't about assuming your spouse will break a promise. Years of care or a remarriage can change the picture even when everyone starts with good intentions.

The same gap shows up with the house. "My spouse can stay" leaves the practical questions open. Picture a hypothetical $24,000 roof repair: your spouse lives there, your children are meant to inherit it later, and everyone agrees it needs fixing. Who writes the check? Your plan should also address the mortgage, taxes, insurance, and what happens if your spouse moves or needs care.

Wanting your children included doesn't mean you distrust your spouse. I look at the actual terms and accounts, who can change beneficiaries, and whether the same money is being promised twice.
