On May 25, an Illinois appellate court determined in Marriage of Escamilla that a person MUST EXPLICITLY waive his or her right to seek maintenance in a pre-marital agreement. Without any explicit waiver, the parties to the pre-marital agreement can still seek maintenance in their divorce.
