Hallelujah and Rejoice! The Dawning of a new Day!

Missouri has long been restrictive on the value of property a person may retain for a fresh financial start or from garnishment or sale.

No longer!

Missouri Governor Mike Kehoe signed House Bill number 1870 which increased the value of exemptions that may be claimed by persons who are seeking bankruptcy protection.

Under the new terms a person can protect home equity of up $40,000.00 (up from only $15,000);

Household furnishing and goods up to $15,000.00 (up from $3,000.00);

An automobile up to $5,000.00 (up from $3,000.00) + up to $10,000.00 of the unused household furnishings exemption.

Mobile home used as primary residence up to $12,000.00 (up from $5,000.00)

Jewelry (not including a wedding ring) up to $1,700.00 (up from $500.00);

A wildcard exemption (to be used on any property) up to $1,700.00 (up from $600.00)!

These provisions will go into effect on January 1, 2027!

What this means is that those persons who had to seek Chapter 13 relief due to excessive equity in property now may be able to seek complete discharge of the debts and obtain a fresh financial start in a Chapter 7 bankruptcy.
