In a workers' compensation case, the Louisiana 2nd Circuit Court of Appeals recently rendered a decision, in the Employer's favor, regarding its intoxication defense to payment of benefits.

Of significance, the 2nd Circuit opined that La. R.S. 23:1081 nor the administrative regulations promulgated in accordance with La. R.S. 23:1081(9), do not require an Employer's drug policy to specify the types or methods of drug testing.

Pursuant to La. R.S. 23:1081, all that's required is a written and promulgated substance abuse rule or policy that provides testing for drug use, and testing performed in accordance therewith.

In Lebleu v. Brookshire Brothers Holding, Inc., the Louisiana Supreme Court recently addressed the denial of a party's request for an Independent Medical Examination (IME) pursuant to La. R.S. 23:1123.

The LA Supreme Court held that, pursuant to La. R.S. 23:1123, an additional medical examination shall be ordered "if any disputes arise as to the condition or the employee, or the employee's capacity to work...." The Court found that the physicians rendered contrary opinions concerning the claimant's diagnosis and her ability to return to full employment and, therefore an addition medical examination is required.

The LA Supreme Court also noted in its decision that the physicians in the Lebleu case were different specialties, and nothing in La. R.S. 23:1123 requires the dispute to be between physicians of the same specialty.

Our Story

In 1999, John Rabalais opened up a solo attorney practice, focusing on the representation of employers and insurance carriers in State and Federal workers’ compensation, personal injury, premise liability, and other employment-related legal matters. John began this venture in a small office in downtown Covington, Louisiana.

In 2000, John was joined by Janice Unland and Robert Lorio, to form Rabalais Unland & Lorio, LLP. As a trio, John, Janice, and Bob worked with employers and insurers all over the State of Louisiana, quickly gaining reputations as detailed-oriented, aggressive trial lawyers.

In 2010, Bob Lorio retired from the practice of law, and the law firm was re-named Rabalais Unland, LLP.

In 2016, Janice Unland retired from the practice of law. Janice continues to serve the law firm in an “Of Counsel” role and is frequently called upon by the young associate attorneys for advice and recommendations on Louisiana law. Janice remains a valuable part of the Rabalais Unland family.
