A woman called me up to represent her daughter for a Motion to Revoke Probation pending in Nueces County, I had represented her daughter for her social security disability case and won.

The issues include that if you are jailed, very long they will terminate your social secuirty disability and you will have to apply again when you get out of jail or prison. And it is by no means certain that you will obtain benefits when you get out of prison and apply again.

Technically, it should be relatively easy to obtain social security disability benefuts again, because most people pjhysical and mental conditions do not markedly improve. But it is not easy.

I am under the impression, that he Social Security Administration thinks, well you had your chance and you blew it. And of course, this is not something that I can prove.

A woman just called me up, who had helped her father when her social security disability case.

However, she was disappointed and he was disappointed, about the fact that they felt that he was entitled to an additional one year in past due benefits.

Therefore, they wanted to hire me to do the appeal, so they could procure that additional year in past due benefits.

The problem with me doing the appeal was that I would have to get to know and read the entire case, including the medical records in order to come up with an appropriate legal and factual argument to appeal the case.

I told her that I could not handle the appeal for the past due benefits.

I stared that if she desired to appeal , she could do so for her father; or, she could look for another Attorney to do the appeal.

That is one disadvantage in handling your own case.

I just completed the appeal of a Judges unfavorable decision on a social security disability case.

My notes reflect that I was interrupted by the Judge four times.

One time I was asking my client, how much he currently weighed, and the Judge told me to "move on" because he already had him listed as "obese."

I stated as one point on appeal that the Judge stated he considered all of the evidence regarding obesity. I stated in the appeal that the Judge could not consider all of the evidence, if he did not consider my clients weight on the date of the hearing.

The obesity of the claimant is supposed to be considered with other related factors, such as musculoskeletal problems in determining a person's physical ability to work.

This was one of two or three arguments, I made on appeal in order to attempt to override the Judges unfavorable decision.

I saw the largest award I have ever seen on a Disability Case so far. About $150,000.00. That is very, very, rare, for several reasons though.

Another point I raised on an Appeal from a denial by a Judge in an unfavorable decision. The Judges regularly ignore the claimant's testimony at the hearings in their decisions:

"The ALJ did not consider the claimant’s testimony at the hearing. The Claimant was denied his right to a hearing or to have his testimony considered at the hearing. The claimant’s testimony was reduced to two sentences, which began, “At the hearing, the claimant. . . . “ (Dec 6, par. 3).
