Please join us in congratulating Tim McMahon and Matt Slater on their successful defense of a slip and fall case in a JAMS arbitration. Plaintiff claimed that our client, the property owner, had negligently maintained a set of stairs thereby causing plaintiff to slip and injure his shoulder as he tried to stop his fall by grabbing the handrail. With the help of retained human factors expert Dr. Ilene Zackowitz, Tim and Matt were able to affirmatively show that the stairs were not dangerous and that plaintiff’s fall was in fact caused by his own misstep, and not the condition of the stairway.

Win on Summary Judgment

The firm is very happy to report that Matt Slater and Bob Lynch just won a motion for summary judgment for a defendant in Riverside County. The court granted the motion on the issue of causation. The court found that that a property owner could not have caused a serious injury to a passing motorcyclist who collided with a vehicle leaving the property owner’s driveway. Congratulations to both Matt and Bob on the win!

We were successful this week on a temporary restraining order that allowed our client to recover more than $200,000.00 in construction equipment from a general contractor that had taken control of the equipment upon contract termination. Our client was a subcontractor on a public works project and was terminated on less than 48 hours notice.

During termination, the GC surrounded our client's personnel and equipment and refused to allow the equipment to leave the site, claiming he had a contractual right to keep the equipment.

The court did not agree and ordered all equipment returned.

Congratulations to shareholder Robert Lynch on a defense verdict today in San Diego County Superior Court.

The case involved Plaintiff's allegations that she had been wrongfully evicted from a local hotel and included claims that she should have been considered a long term tenant instead of a transient guest and that she was entitled to statutorily required penalties.
