This cannot be overstated enough: the bank you work with matters! Choose a smaller bank and establish a relationship with them. As an attorney who must deal with banks and court orders OFTEN, please heed my advice for your own sanity. AT ALL COSTS, avoid the bigger banks like Truist, Wells Fargo, Bank of America, Chase, Citi etc. They all often have only ONE number nationwide for their legal department and that number is not even accessible to us lawyers- only bankers. I had to go in person three times today for the simplest transactions, made impossible due to absolutely ridiculous policies. Who must pay the price? My clients! Naturally I intend to petition the court for reimbursement wherever possible (in this case, illegal requirements) but that is wholly within the purview of the judge. It’s graduation season! If you’re like me and have a graduating senior in the house, once your child turns 18, you can no longer make all of their medical and financial decisions anymore! That means your child needs a durable power of attorney for legal and financial decisions, and a living will/health care surrogate for medical decisions. Make sure your child is ready to take on the world and call me for fast and easy preparation of these documents. Every adult should have these at minimum! Congrats class of 2025!!

Tragic situations can be made easier with proper planning!

I recently agreed to accept a pro bono matter with Broward Lawyers Care for two boys who will each need their own guardianship because they are inheriting monies in excess of $15,000 from an estate. It is a very tragic situation even without the need for my involvement, as they are now in their 4th home. While these boys are certainly lucky to be inheriting money, (their caregiver qualifies for indigent status and I've agreed to take on their matters for free) imagine for a moment your own situation if you have minor children.

These guardianships typically cost a lot of money, both in costs and legal fees. With proper estate planning, the money you have earmarked for your children will go directly to them at the appropriate time, rather than to an attorney and partially eaten up in a probate and guardianship.
