You moved to Florida. Great.

But if your estate plan is still sitting in a folder from another state, do not assume it automatically works exactly the way you expect it to here.

A lot of documents may still be valid after a move. That does not mean they should be ignored.

Florida real estate, different probate rules, an older Power of Attorney, changes in your marriage or finances, or simply the fact that your life looks different now can all be reasons to review the plan.

Sometimes it only needs a few updates. Sometimes it needs more.

The important part is finding that out now, not when your family is trying to use the documents during an emergency.

If you moved to Florida and brought your estate plan with you, make sure the plan made the move successfully too.

If your estate plan was created in another state, I am not automatically going to tell you to throw the whole thing away.

That would be ridiculous.

But I am going to tell you to have somebody look at it.

Moving can change more than your mailing address. You may own Florida real estate now. The local probate process may be different. Your old Power of Attorney may raise questions when somebody actually tries to use it. And there is always the possibility that your life has changed more than the documents have.

Maybe you got remarried. Maybe the kids are older. Maybe the person you chose to make decisions twelve years ago would not even make your top five today.

Sometimes an estate plan only needs a few updates. Sometimes it needs more.

The important part is finding that out now instead of when your family is trying to use the documents during an emergency.

You packed the furniture. Changed your address. Got the Florida license plate.

But what happened to the estate plan you signed ten years ago in another state?

For a lot of people, the answer is, “It is in a folder somewhere, so I assume we are good.”

Maybe you are.

An out-of-state estate plan may still be legally valid after you move to Florida. But “valid” is not necessarily the same thing as “still works exactly the way I want it to.”

Florida law may affect how certain documents are used. You may own different property now. Your family may have changed. The people you chose as decision-makers years ago may not even be the people you would choose today.

You moved to Florida. Welcome.

Your estate plan did not burst into flames somewhere around the state line, but that does not mean you should shove it in a drawer and assume everything is fine.

A will, trust, Power of Attorney, or healthcare directive created in another state may still be valid. The better question is whether it still works the way you expect it to here.

Maybe you bought Florida real estate. Maybe your family situation changed. Maybe the person you named years ago is no longer the person you would choose today. Or maybe the documents are technically valid, but not nearly as practical as they should be under your current circumstances.

Moving does not always mean starting over. It does mean your plan deserves a review.

The nursing home is asking how you plan to pay.

Mom needs care. The bills are starting to come in. Someone in the family heard Medicaid will pay, somebody else says you need to move the money, and your neighbor has a fascinating story about what worked for his aunt.

This is generally not the ideal environment for financial decision-making.

A long-term care crisis can force a family to learn a complicated set of rules very quickly, and panic is exactly when people start making moves they may regret.

There may still be planning options after a crisis begins. But knowing the rules earlier usually means you have more time to understand the choices instead of reacting to whatever somebody told you in the nursing home parking lot.

Before you start transferring assets, giving money away, or rearranging accounts, find out what actually applies to your family's situation.

“My family knows what I want.”

I believe you.

The bank may be slightly less sentimental about it.

One of the biggest estate planning assumptions I hear is that a spouse or adult child will simply be able to step in if something happens. Sometimes families know exactly what Mom or Dad wanted, but knowing the plan and having the legal authority to carry it out are two very different things.

Banks want documents. Healthcare providers want documents. Financial institutions generally do not operate on, “Trust me, Dad told me I could.”

That is why incapacity planning matters just as much as deciding what happens after you die.

Imagine your spouse is in the hospital and unable to make decisions.

You know what they want. Your kids know what they want. Everybody agrees.

Great.

Now the bank wants to know who has legal authority to access an account. The doctor needs to know who can make a healthcare decision. Someone needs to sign something, and suddenly “we all know what Mom would want” is not enough.

This is the part of estate planning people tend to miss. It is not only about who gets your property someday. It is also about who can legally step in for you while you are still alive.

Those decisions are much easier to make before your family is standing in a hospital hallway trying to figure them out.

Estate planning has a terrible deadline.

Mostly because nobody tells you what the deadline is.

There is no reminder that pops up and says, “Just a heads-up, somebody is going to be in the hospital two Tuesdays from now. You may want to finish that Power of Attorney.”

Usually people put this off because everything is fine. Then something happens, and suddenly the family is trying to figure out who can access accounts, talk to doctors, sign documents, or make decisions while everyone is already stressed.

I would much rather have that conversation with you when absolutely nothing exciting is happening.

If “eventually” has been your estate planning timeline, now is a pretty good time to move it up the list.

Can a Joint Account Override an Estate Plan?

Jointly owned accounts often pass directly to the surviving account holder, regardless of what an estate plan says. Adding a child as a joint owner may unintentionally leave other beneficiaries with less than expected, creating confusion and family disputes. Reviewing account ownership is an important step in keeping an estate plan consistent.
