Joint Bank Accounts Won’t Always Avoid Probate.

My spouse is on the bank account with me.”

Legally, that’s called joint ownership with rights of survivorship.

And yes — that is better than nothing.

If one spouse passes away, the surviving spouse can usually continue using the account normally.

But here’s the question most people never ask.

What happens if both spouses pass away together?

A car accident.
A medical emergency.
A sudden event.

If there are no other names on the account and no additional planning in place, the account can still freeze.

And when that happens, the estate may end up right back in probate.

Probate Is NOT About Your Bank Account Balance.

Many people think probate only happens if a bank account has a lot of money in it.

But that’s not how probate works.

Probate is not triggered by the size of one bank account.
It’s triggered by the value of your entire estate combined.

Most states have what’s called a small estate threshold.

And that number is not very high.

In many states it’s around $75,000.
In some states it’s even lower.

And in Florida, the threshold is lower than most people expect.
That means even a small frozen bank account can push an entire estate into probate.

Why Your Will Won’t Unlock Your Bank Account

Many people believe their will controls their bank accounts.
But in Florida, that’s not how it works.
When someone passes away, the bank does not read the will to decide who gets the money.
Instead, the bank only looks at:
• How the account is titled
• Whether a Payable-on-Death (POD) beneficiary is listed
• Whether the account is owned by a trust
If the account is in your name alone with no beneficiary and no trust, the bank will freeze the account until probate court appoints someone with authority.
That’s why many families are shocked.
Even if the will clearly says who should receive the money — the bank cannot release it yet.
Until probate is opened and a personal representative is appointed, the funds stay locked.
