When a business owner is getting divorced, one of the first questions they ask me is, "Is my spouse entitled to half my business?" The honest answer is that it depends. This post assumes there is no prenuptial between the parties. If there isnโt than this information applies.
A business started during the marriage is generally marital property in Florida. Even a business you owned before the marriage can have a marital component if it grew because of either spouse's work or marital money went into it.
So the real question is usually what the business is worth. That's where couples have a choice.
In a contested divorce, each spouse often hires their own valuation expert to value the business. The two reports rarely match. The lawyers argue about which one is right at trial, and a judge decides the value and even which date it's measured on. Meanwhile, you're answering discovery requests and sitting for depositions instead of running your company.
When you and your spouse agree on the value before filing, you stay in control:
โข You both choose how to value it: one neutral appraiser you both trust, your accountant's numbers, or a figure you both accept
โข You both choose the valuation date
โข You both pay for one valuation, not a battle of experts plus hourly legal fees
โข Your clients, employees, and vendors never get pulled into your divorce
โข You both structure the buyout โ a lump sum, other assets, or payments over time โ in a way your business can actually afford
One thing doesn't change: both spouses still have to be open about the business's financesโand their personal finances. That transparency is what makes an agreement fair and keeps it from being challenged later.
If you can agree, I can handle your divorce for one flat fee, quoted up front after a free 15-minute call. The fee includes preparing your settlement agreement, filing, handling the case through final judgment, and unlimited legal advice along the way to help keep things uncontested. Of course, the flat fee quoted is just for legal representation of one spouse, and does not include any expert services needed for valuation or the filing fee. In Miami-Dade, uncontested cases are processed without a court hearing.
