🇮🇹 Italian Supreme Court Resolves the “Minor Issue”

On July 26, 2026, the United Sections of the Italian Supreme Court of Cassation (Sezioni Unite) issued Judgment No. 24045/2026, providing definitive guidance on one of the most debated issues in Italian citizenship by descent.

The Court held that a child born abroad to an Italian citizen, who acquired the citizenship of the country of birth by ius soli, retains Italian citizenship even if the Italian parent later naturalized as a foreign citizen while the child was still a minor.

This decision rejects the interpretation that a parent’s naturalization automatically interrupted the transmission of Italian citizenship to a minor child. As a result, the so-called “minor issue” has now been authoritatively resolved by Italy’s highest court.

The judgment is expected to have significant consequences for many pending judicial proceedings, as well as for cases that were previously denied based on this interpretation and may now be reconsidered on appeal.

Our firm is carefully reviewing the Court’s reasoning and evaluating its impact on our pending cases and ongoing appeals.

Born Italian, lived as an immigrant, became American🇮🇹🇺🇸

It has been a journey made of sacrifices, many different legal statuses, uncertainty, nostalgia, fear, and tears.

But this Country gave me opportunities, dignity, and a future, for me and for my family.

Today I am not simply receiving another citizenship.
I am carrying in my heart a second homeland.
