Although it's a second-degree misdemeanor, a conviction can carry penalties of:

Many Florida drivers still believe that the odor of ma*****na automatically gives law enforcement the right to search a vehicle. But recent court decisions have changed the legal landscape.

⚖️ Florida's Fifth and Second District Courts of Appeal have ruled that the smell of ma*****na by itself is no longer enough to establish probable cause for a vehicle search. While odor can still be considered, it cannot be the only factor used to justify a search.

🚨 Riding an e-bike doesn’t automatically mean you’re outside a DUI investigation.

Police may stop an e-bike rider when they see behavior that raises concerns, like weaving through traffic, ignoring signals, nearly hitting a car or pedestrian, or receiving a call about the rider’s safety.

And once an officer suspects alcohol or drugs may be involved, the encounter can become an impaired-driving investigation.

Many people don't realize that a DUI arrest can affect their driving privileges before their criminal case is resolved.

Here's what you need to know:

🚗 If you provide a breath test of 0.08% or higher, your driver's license may be suspended for 6 months.

🚫 If you refuse a breath, blood, or urine test, your license may be suspended for 1 year. A second or subsequent refusal can result in an 18-month suspension and additional criminal charges.

After your arrest, the officer will typically take your license and issue a Uniform Traffic Citation, which generally serves as a temporary driving permit for 10 days.

⏳ You only have 10 days to request a formal review hearing with the Florida Department of Highway Safety and Motor Vehicles (DHSMV) to challenge the suspension. Missing this deadline could affect your ability to continue driving.

The decisions you make in those first 10 days can have a significant impact on your driving privileges and your case.
