Thirty years later, we remember the 110 lives lost in the ValuJet Flight 592 tragedy and the lasting impact this disaster had on safety in the United States.

The crash remains the deadliest aviation disaster in history and the first and only U.S. aviation disaster to result in a criminal conviction of a company for its role in the crash.

Podhurst Orseck, P.A. Managing Partner Steven C. Marks served as Lead Counsel for the state court plaintiffs and as a member of the Plaintiffs’ Steering Committee in the federal multi-district litigation.

Following news of a planned wrongful death and products liability lawsuit against OpenAI - filed by the family of a man killed in the 2025 Florida State University shooting - these issues are moving from theory into the courtroom.

In a recent feature by Law.com and the Daily Business Review, Partner Ramon Rasco weighed in on the case and its broader implications.

“The question here is, what exactly were the messages from the chatbot?” Rasco said. “Assisting or advising on how to carry out a mass shooting is something that, to me, is a clear product failure…there are clear guardrails that could be put into place to prevent such a thing from happening.”

As these cases evolve, they signal a new frontier in products liability, raising important questions around foreseeability, responsibility, and the need for safeguards as AI technologies rapidly advance.
