A D.C. federal court denied Aenergy’s motion for reconsideration of the court’s order granting Angola’s Motion to Dismiss Aenergy’s 1.1B claim for breach of power plant projects. The decision aligns with prior rulings by the Southern District of New York and the Second Circuit, affirming that the dispute belongs in Angola. Michael D. Ehrenstein of Ehrenstein Sager commented, "The Angolan defendants are pleased that the court denied Aenergy's motion for reconsideration of its judgment. Just as the New York District Court and the Second Circuit Court of Appeals concluded, the Court properly dismissed Aenergy’s claims, finding that the dispute must be adjudicated in Angola.

The Republic of Congo successfully argued for the dismissal of a construction company's claim to seize a Trump condominium, allegedly bought with embezzled funds by the President of Congo's daughter. U.S. District Judge Katherine Polk Failla agreed with Congo and a related entity, Ecree LLC, that Commisimpex, the company trying to enforce about $1 billion in arbitral awards, had failed to convincingly link the purchase of the condo to the embezzlement of funds. The judge also dismissed the claims due to jurisdictional and ex*****on immunity issues under the Foreign Sovereign Immunities Act.

This case is significant because it touches on a number of important legal principles. Firstly, it underscores the challenges of enforcing international arbitration awards, especially when they involve potentially fraudulent transactions and third parties. The case also raises the sensitive issue of sovereign immunity, a principle that can shield foreign governments from the jurisdiction of U.S. courts. Commisimpex argued for an exception to immunity based on the commercial nature of the property, but the court did not accept that argument. Finally, the outcome sets a precedent for future disputes, showing the difficulties claimants may face when trying to enforce arbitral awards against sovereign nations.
