Earlier this week, had the absolute pleasure to be a guest speaker at the University of Illinois Chicago Law School to discuss counseling clients and negotiations via Zoom.
It was a wonderful opportunity to share my experiences and strategies with aspiring attorneys as they prepare to make the leap from the classroom to the real world. He thoroughly enjoyed the dialogue and the questions. Huge thank you to our client, Prof. Justin Van D**e for the invitation, and to all the students for their enthusiasm and participation.

Interest rates are at historic lows and the market is on fire. People are also taking advantage of these rates by refinancing and pulling available equity out of their homes.

So what does this have to do with ? More and more people will find themselves renovating a new or existing home, which means hiring contractors and undergoing projects, large and small.

Here are 8 tips for your next :

1) ask friends and family for recommendations; good and bad. This is a great place to start. Compile a list of potential contractors and get estimates and their typical terms.

2) when picking a contractor, don’t be afraid of negotiating price and terms. Also ask your candidate about experience with projects similar to yours.

3) be wary of hefty deposits. Progress payments are the best option on large projects/new construction. Many lenders require this on new construction. Progress payments typically keep the project moving, but the homeowner must honor the arrangement by making timely payments upon completion of work.

4) don’t be afraid to request license and insurance information. “Insurance” often means worker’s compensation and general liability to cover the contractor if one of their workers gets hurt on the job or if your property sustains damage.

5) be transparent with your contractor and express concerns and point out issues you find during the job, preferably in writing. It is typically easier to address problems when they first arise versus trying to fix them when the job is all done.

6) get releases! When you pay your contractor, make sure you know what you’re paying for and whether the payment will be used to pay a subcontractor. This protects your property from improper liens being placed on your property.

7) take pictures, not just from a progress perspective, but also from a memory building perspective.

8) have fun and enjoy the ride! A well coordinated project is should result in a less complicated project and a more pleasant experience!

Happy Tuesday, everyone! It’s been a while since I last posted, thankfully it is because we are busy!

I’ve been meaning to create a post about advertisements I have seen lately on social media for estate planning services (i.e., creating a will or a trust). Shockingly, while these companies offer these legal-type services, many of these companies do not give actual legal advice. That seems counterintuitive to me! It’s true; not everyone needs a super sophisticated estate plan. But there is certainly no “one-size-fits-all” and at the core of every estate plan is an in-depth understanding of the legal implications of what is written in each document. In other words, how can a website that does not offer legal advice properly tailor a client’s estate plan? I’m not sure that is possible. To me, these sites are similar to getting medical advice and having your chart created on webmd.

Years ago I worked as an associate at a large defense firm. I was handed a large volume of cases from the get-go. No problem. I started going through the files and found a few of them were close to settlement, so I reached out to the clients and my opposing counsels to see if those could be resolved and secure releases for my client. I thought I was doing right by the client and firm, until the managing partner got wind of my little project. He walks into my office and says, “you know, settling these cases is bad for business.”

As a young attorney, I thought I made a mistake. That comment from my boss made me believe resolving cases was detrimental to the firm and risked my job security.

Years later, after having handled thousands of cases, and building client relationships, I’ve learned and realized what my then-boss told me is simply not true. Resolving cases when it is practical to do so is not bad for business - it’s great for business. As lawyers, our clients come to us to resolve their issues, not for us to profit off of them. Sure, we need to make a living, but when you shift your focus from a “bill a file” mentality into a “solve this problem” mentality, you become a valuable resource for your client, and not a financial burden.
