If you are detained - or worse - for exercising your 1st Amendment rights in opposition to a tyrannical, fascist, xenophobic government, this is a reminder that a significant part of our practice is civil rights litigation.

Attorney Martin had some things to say about a recent Bankruptcy Court decision affecting your homestead rights:

New Hampshire bankruptcy attorneys are raising alarms about a recent court order that they say radically changes how the state’s “homestead” law protects homeowners who fall on hard times.

"To me, these cases are, were, and have always been about free speech," said Concord lawyer Seth Hipple, who represented five of the defendants. Today, the Coös County Superior Court held a hearing on Riverside Speedway's request for temporary injunctive relief against Governor Sununu enforcing emergency orders requiring speedways to remain closed to the public.

Because of last minute changes to reopening guidance for speedways, which take effect on Monday, the Court did not reach the merits of the claims, as it believed the need for an injunction was moot.

Attorney Martin explained, however, that the current orders, which remain in effect through the weekend, leave Riverside at risk for enforcement if it holds a race with spectators.

After conferring with the Governor's Counsel, the Governor agreed not to enforce the current orders this weekend if Riverside opens within the framework of the June 15 guidelines.

Riverside nevertheless reserved its right to challenge the validity of the new guidelines.

A judge accepted an agreement Friday morning between attorneys representing a Groveton speedway and the governor's office regarding a lawsuit that was filed.
