Future litigant alert! We are super excited for Ben Tobey, his wife Ellie and their daughter Maggie who welcomed new baby Myers Tobey to the family this week! Myers is adorable and so far, doesn't create a fuss unless really provoked - just like her dad. The only negative is that firm mascot Gracie the yellow lab has been staying home with Ben during his paternity leave. We miss her - and Ben as well. Congrats Tobeys!

Strange but true! A Moretz Law Group client was JAILED briefly over the weeked for accidentially letting their workers' comp insurance expire! Usually failure to maintain WC insurance is something handled summarily through the NC Industrial Commission. In this case, the client missed the notices mailed to them by the IC and unfortunately also mis-calendared the court date which resulted when the IC filed misdemeanor charges. They've got their insuance in place, but now they still have to deal with the failure to appear, which is a separate charge and resulted in the brief jail visit when they were pulled over for a routine traffic stop. All employers with 3 or more employees are REQUIRED to maintain IC insurance, and just because you might claim someone is an independent contractor doesn't mean they don't count toward the 3-employee minimum. Don't let a small mistake spiral - keep that WC insurance up to date! If you have true independent contractors, have them sign a contract so you have support for your position. This is great reminder. Especially as our population is aging, these issues will affect more and more of us. Let us know if we can assist you with your estate plan - we always work closely with your CPA and other financial advisors in doing so. 

When a husband or wife dies, the surviving spouse may eventually face a higher income tax bill. Why? Filing status shifts from married filing jointly to single or head of household, triggering higher tax rates at lower income levels. So, if income remains relatively steady, the survivor can be pushed into a higher bracket. In addition, required minimum distributions from retirement accounts can increase taxable income. Careful evaluation of spousal IRA rollover options based on age and cash-flow needs may help. But the right approach depends on each individual’s circumstances and goals. Today all our new cyber security software became fully operational. Due to the increased risk of cyber crime we had See the Matrix, (STM) do a full security analysis and have now upgraded all of our systems to keep our clients’ data more secure. It has been a good bit of expense and quite a bit of a learning curve but we certainly are sleeping easier. ✅
