Notice re important change in Maryland Law related to short sales!!!

Maryland has now passed a law (the Maryland Mortgage Assistance Relief Services Act) that essentially prohibits real estate agents from negotiating short sales of properties with banks.

However, attorneys can still negotiate short sales with banks, and a short sale can be a very complicated process with significant tax consequences.

This Washington Post article highlights a significant misunderstanding of homeowners in foreclosure.

Simply abandoning the property does not resolve your problems with the bank. After a foreclosure sale, the bank can still sue you for the difference between what you owe and what the house sold for.

If you are in foreclosure, you need to be proactive, consider filing for bankruptcy or short selling the property to resolve your liability.

Be aware of loan modification scam artists and know the rules!

1) only a law firm can charge you in advance for a loan modification; 2) a law firm must have attorneys who are allowed to practice in your State to represent you; 3) a law firm can only charge a "reasonable" fee. Firms that charge a flat fee every month regardless of the time spent and results achieved are not charging a reasonable fee.

Are you considering a short sale of real property? Keep the tax consequences of the forgiven debt in mind.

If it is your primary residence, by law, any debt forgiven by the bank will not be taxed as income. However, if the property is not your primary residence, the forgiven debt will likely be considered income on which you will have to pay taxes.

Do not be scared into paying creditors when you are protected!

To often we get calls from people, especially elderly individuals, on social security who are frightened that they have been sued and their benefits are going to be garnished.

By law, social security benefits are 100 percent protected, so no creditor can garnish that income. In fact, any threat to garnish that income could entitle you to monetary damages.

Make educated decisions when you are dealing with debt problems!

People sometimes try to resolve debt by negotiating a reduced payment to a creditor. If you do this, the debt that is forgiven is considered income. So if you have a $15,000 credit card bill and the credit card company forgives $9,000, you will pay income tax on that $9,000.
