This is only the third month of the year and I have done several Premarital Agreements (Prenups) for clients. Would you sign a Premarital Agreement if your future spouse asked you to? If a future spouse refused your request to sign would you cancel the wedding?

Marriage is not just a piece of paper. It's a piece of paper that gives you legal rights. It gives you rights to your spouse's assets (property, bank accounts, social security, military benefits, etc.) and it allows you to make your spouse's healthcare decisions. These rights exist even if your spouse has been living with a side piece for 20 years. So when Richard "Dimples" Fields said "She's Got Papers" you'd better respect that. Call my office if you've got papers.

Are you a woman who took your husband's last name and are now getting divorced? Always request to resume use of your maiden name. If you don't make that request, and subsequently change your mind, you will have to file a new action to get a name change. Name changes are not automatic. You have to take additional steps for the name change to occur.

"To Have and To Hold" is one of the marriage promises we make before God, family and friends."To Have" is easy. "To Hold" is more difficult. It's easy "to have" someone but doing what's required to keep (to hold) them is difficult for many. I see this daily in my law practice.
