Today marks the beginning of Rosh Hashana, The Hebraic New Year. I am not Hebraic in decent, but I stand with Israel in this struggle with Palestein. I do not believe the Palestinian people are bad or terrorists, I believe they are being used by Islamic Fundamentalists which due to the traditions of the Palestinians there is little they can do.

Let us seek to Have a Good Year and to Enjoy a Sweet Year. Regardless of your faith, nationality, color, s*x, or even s*xual orientation, it is my hope that you should enjoy a life that is filled with happiness and goodness, not one plagued with bitterness and turmoil.

I need my friends out there in Facebook land to help if you will. It is a big ask, but it is valid and it is just.

So, August 28, 2020 RSMo 571.070 Possession of firearm unlawful for certain persons - penalty - exception. -
1. A person commits the offense of unlawful possession of a firearm if such person knowingly has any firearm in his or her possession and:
(1) Such person has been convicted of a felony under the laws of this state, or of a crime under the laws of any state or of the United States which, if committed within this state, would be a felony; or
(2) Such person is a fugitive from justice, is habitually in an intoxicated or drugged condition, or is currently adjudged mentally incompetent.
2. Unlawful possession of a firearm is a class D felony, unless a person has been convicted of a dangerous felony as defined in section 556.061, in which case is is a class C felony.
3. The provisions of subdivision (1) of subsection 1 of this section shall not apply to the possession of an antique firearm.

Now on August 5, 2014 the Missouri Constitution Article 23 Section 23, was changed to the following. "Right to keep and bear arms, ammunition, and certain accessories—exception—rights to be unalienable.—That the right of every citizen to keep and bear arms, ammunition, and accessories typical to the normal function of such arms, in defense of his home, person, family and property, or when lawfully summoned in aid of the civil power, shall not be questioned. The rights guaranteed by this section shall be unalienable. Any restriction on these rights shall be subject to strict scrutiny and the state of Missouri shall be obligated to uphold these rights and shall under no circumstances decline to protect against their infringement. Nothing in this section shall be construed to prevent the general assembly from enacting general laws which limit the rights of convicted violent felons or those adjudicated by a court to be a danger to self or others as result of a mental disorder or mental infirmity".

I read that to mean the Constitution restricts the right of the General Assembly (Missouri Legislatures), from enacting any laws that limit or infringe upon the rights of anyone aside from convicted violent felons.

Missouri Courts have disagreed in recent cases. In 2013, Section prohibiting persons convicted of certain felonies from possessing fi****ms is not an ex post facto law because it does not apply to conduct completed before its enactment. State v Harris, 414 S.W.3d 447 (Mo.Banc)
Then in 2015, Section criminalizing possession of a firearm by a convicted felon does not violate state constitutional right to bear arms. State v Merritt, 467 S.W. 3d 808 (Mo.).
Also in 2015, Section is narrowly tailored to achieve a compelling governmental interest in ensuring public safety and reducing firearm - related crime and thus passes strict scrutiny. State v McCoy, 468 S.W.3d 892 (Mo.)
Further in 2015, Section is a constitutional restriction of a convicted nonviolent felon's right to bear arms. State v Clay 481 S.W.3d 531 (Mo.)
In 2018 the Courts drafted a lengthy opinion stating Section does not violate Second Amendment of the US Constitution as applied to person who had committed two serious felonies for which he served prison time, even if his federal right to posses a firearm had been restored. Alpert v. State, 543 S.W.3d 589 (Mo. Banc).

However on May 9, 2024 in U.S. v. Duarte, the Ninth Circuit Court of Appeals found a law prohibiting some criminals from owning fi****ms violated the Second Amendment.
Also, the 3rd U.S. Circuit Court of Appeals ruled Tuesday, June 6, 2023, that nonviolent offenders should not be subject to lifetime gun bans, given a recent Supreme Court ruling (Bruen Decision) that instructs judges to look to historical tradition, not competing interests, to decide cases.
Historically speaking, the rebels who took part in the 1787 tax uprising in Massachusetts known as Shays’ Rebellion could generally get their weapons back after three years.

A lifetime ban on firearm rights is Excessive and Cruel.

And on the heals of the sad and tragic events of July 13, 2024 in Butler, PA it is part of that double edge sword we live with.

So am I bringing this up? I am a Bail Bondsman and I bailed a husband and wife out of a Missouri Jail a few days ago. Their charges were Unlawful Possession of a Firearm. Their son is married and he left a shotgun at his parent's home to prevent his children from getting to it. It is legal and lawfully registered to the young man. The parents each have a conviction for drug use, back when ma*****na was illegal, part of that was expunged, but I think the paraphernalia charges stuck. A third party, illegally entered the home, while they were at work and observed the shotgun leaning in the corner of the home and knew their history. The third party reported it to the sheriff's department, who executed a swat tactical breech of the home at 6:00 AM.

These are good people with a mistake in their past and they themselves have no weapons, they were just looking out for the safety of their grandchildren. They are speaking with attorneys now to find representation on this case. As it may be a case to go to the US Supreme Court as Fed Appeals Courts are saying it is unconstitutional to permanently ban a person from owning a firearm, they will need financial assistance to cover legal fees.

I think this case is ripe for a review of Missouri Gun Laws, because our legislatures are not doing anything to help the situation. They draft laws, but still Judges disregard them, it needs to be an absolute, black and white decision, that is clear and firm. Until then, we will have cases like this.

So the General Assembly is authorized to enact general laws that can limit the rights of convicted violent felons, otherwise the state of Missouri shall be obligated to uphold these rights and shall under no circumstance decline to protect citizens from that right being infringed upon.

May be having our first Supreme Court case to clarify this and Boone County to suffer one hell of a lawsuit, making a couple of local residents wealthy for the civil rights violation committed by the Boone County Sheriff's Department, if their actions are declared to violate the Constitution of Missouri. Interesting times ahead.

Here is a perfect example of the benefits of hiring a Private Investigator, but please understand, this is the absolute worse of circumstances and I feel horrible for this family.

In 2009, Christine Whittaker a 21 year old resident of Hannibal, Missouri came up missing. She is the mother to a daughter Alexandria who was 6 months old at the time, but today would be eligible for her learners permit. Milestones missed.

To save embarrassment or the fear that authorities would not look for her due to her past, they presented the image early on that she was Mary Poppins basically. Which was a disservice to the family and Christine, because it was the locals they needed the help from, the locals already knew her history, why try to hide that? Hiring a Private Investigator, we work for the family, we don't judge, we don't care about if you do/did drugs, we don't care if you were a pr******te, or the Mother Mary herself, we want to find your loved one. We can't trespass, but we can often times gain access through conversation, that police can't, especially with people in the drug world...we have no power of arrest so I can basically sit and watch you shoot up with he**in and all I can do, is treat you with Narcan if you have a bad trip.

The family and the journalist, submitted potential evidence to the authorities and it went nowhere. Major injustice for the family. A former FBI Special Agent, sent pictures to a County Coroner who was able to confidently state the bones were not of human nature. However, they did not process the evidence. I would have given samples to Hannibal Police Department, to Missouri Highway Patrol, and sent samples to my own independent lab...just like the Bible, by the confirmation of three there shall I be.

I believe the family is qualified for a wrongful death suit, because there is clear evidence Christine was a Confidential Informant for the County District Attorney and was assigned to an officer. Another officer, told his CI of Ms. Whittaker's status, placing her in peril. This act on it's own would be questionable, but probably not enough to warrant a Wrongful Death Suit. However, the follow-up investigation (or lack thereof) along with the conduct of the department screams cover up and seeking plausible deniability.

So many leads unfollowed. So many erroneous leads followed. Now, the property that was previously owned by Glen Ledbetter has a well on it, that may be her final resting place. The new owner seeks to capitalize from this families tragedy and the police have not pushed the courts for a limited Warrant for the search of the property, when there is sufficient probable cause for a search.

HPD has not reached out to the available resources at their disposal to perform arial investigations, use of radar equipment from a helicopter...yet private investigators will do that, but it costs.

HPD has not initiated a cell phone ping of the phones of the suspects involved to see who pinged from the same areas as she did at that time, further, was there any additional activity between Ms. Whittaker and others? I can only theorize that the HPD stonewalling and delaying the case as much as they did, there is something unspoken? Also, most criminals would not know to discard a person's cell phone, especially in 2009, unless they thought she was using it to record their conversation to give to the police or it was the handler who was scared of being exposed for something he was doing illegal.

The errors made by the HPD are staggering. I believe Bill Rinehart the Private Investigator who initially started on the case, did a very thorough job in going where the evidence took him and not get in to the issues of her past.

As more and more police departments go underfunded, under staffed, and under trained your interests may best be served through the employment of Private Investigation services. We have already seen box stores, like Walmart, Home Depot, Lowes, Target, and others hire Private Investigators to sit on store sites and perform loss prevention as it keeps their employees from being placed in unsafe and volatile situations, which I am sure OSHA and their workmen's compensation provider is very grateful for.

Once we have discovered a criminal act, we report the situation to our client and we inform the Authority Having Jurisdiction of the matter to allow them to pursue the matter.

We can also be retained to prove your innocence when falsely accused of a crime. We can search, without corrupting, computers to verify the existence of alleged illegal content. We can work to take the existing evidence and recreate a case to by the opposing position to a jury and offer a plausible explanation for the circumstances, you know the police won't do that for you.

Again, I have serious questions concerning the handling of this case by the Hannibal Police Department. I understand why the family said what they did early on, but in truth it may have hurt their chances of an early location. Now, 15 years later, the truth may never be known and that is extremely unfair to the daughter robbed of a mother.
