This was a highly contested case that began with a zero offer. The driver was never charged with DUI. The bar disclaimed any responsibility. The insurance company claimed no evidence of over-service. However, we knew a man's life had been permanently altered by an intoxicated driver, who in fact had been over-served, and that the insurance company was going to one day owe the policy limits.

So attorneys Kenny Berger and Paul Coyle of the Law Offices of Kenneth Berger teamed up with Justin Jones of Wilkerson, Jones & Wilkerson to collect the evidence and prove the case. We met with the driver at his home and got him to come clean on how much he drank - and smoked - at the bar. We deposed the bar owner and obtained admission after admission. Then we gave the insurance carrier the opportunity to pay the policy limits and protect its insured, or face a massive verdict.

They finally did the responsible thing, paid the $1,000,000 policy limits, and settled the case.

Our client faces a long road, but he will do so with the financial resources needed to provide for his family and continue his path toward healing.

A defense verdict forced Monte Tynes and his team to take a hard look at their own process.
