Making the switch from a 2-year conditional green card to a 10-year green card is a critical milestone in your immigration journey—but it’s also a step where many stumble. Don’t let these common mistakes derail your progress:

✅ Know Your Timeframe: You can apply up to 90 days before your conditional green card expires. Missing this window can lead to complications.

✅ Use the Correct Form: You’ll need to file Form I-751 (Petition to Remove Conditions on Residence). Filing the wrong form, such as Form I-90, could cause denials, delays and start of immigration proceedings against you.

✅ Filing Options:

Joint Filing: If your marriage is intact, you’ll file jointly with your spouse.
Waiver Filing: If you're divorced, separated, or facing challenges in your relationship, you can still apply by requesting a waiver of the joint filing requirement—sometimes even earlier than the 90-day window.
Navigating this process can feel overwhelming, but you don’t have to do it alone.

👉🏼 EB-1A for those exceptionally gifted in athletics, education, science, art, or business. We help build a strong application to showcase your achievements and prove your extraordinary status in your field.

👉🏼 EB-2 NIW for those with a Masters/PhD or exceptional ability in science, arts, or business and who can show your vital role in US national interests. We assist in gathering evidence of your qualifications and contributions to prove to USCIS why you deserve an approval.

US Citizens over the age of 21 can sponsor their parents for a green card. A US citizen can begin the process immediately upon reaching the age of 21. This process can be accomplished regardless of whether the parent is in the US or abroad. If your parent is in the US and entered unlawfully, they must be granted advance parole through TPS or DACA or receive military parole in place to get their green card inside the US.

Documenting your parent/child relationship, submitting appropriate biographical documents and meeting the financial qualifications for becoming a sponsor are some of the most important step in the process.

If you recently turned 21 or became a US citizen and would like to sponsor a parent, call us at 202-713-5659 for more information. We assist clients in Nepali, Hindi, and Spanish in all 50 states and internationally.

Third Preference (EB-3) category is for foreign workers who have a bachelors degree or possess skills in a particular occupation. It is also available for unskilled workers such as those in the food service, gas station, construction or other industries. There are four main steps to complete the process:

1. There must be a US employer interested in offering you a job and willing to pay a wage set by the Department of Labor
2. The Employer must try to recruit US workers for the job and prove that it chould not find any qualified workers
3. After successful recruitment, employer must file an I-140 petition with USCIS showing it has the financial ability to pay the worker's wage and that the foreign worker meets the employer's job requirements
4. If the foreign worker is in the US, he/she can apply for adjustment of status. Those outside the US can apply for an immigrant visa at the embassy through the process of consular processing.

If you are a lawful permanent resident and are married to a US citizen, you may be eligible for citizenship three years instead of five years.

You must also meet other eligibility criteria for US citizenship including physical presence, maintenance of residence and not being convicted of certain crimes. You can submit your application three months before the date of your third lawful permanent resident status anniversary!

You can also file for citizenship if you still have a pending Form I-751, Removal of Conditions with USCIS. This speeds up the process of you becoming a US citizen and you only have to attend one interview!
