With a nesting agreement, the kids stay in the family home and the parents take turns living there instead of the children packing a bag and shuttling between two places. One parent is in the house for a stretch, then swaps out with the other. Colorado law does not have a rule specifically for nesting, so it simply becomes part of your parenting plan, and a judge will sign off on it as long as it works for your children. A good agreement covers the basics up front: who is in the house on which days, who pays the mortgage and bills, where each parent stays when they are off duty, ground rules for the home, and how long the arrangement will last before you move to a more traditional schedule. Most families use it as a soft landing during the first stretch of separation, since keeping three roofs over your heads and staying this closely coordinated gets tough to keep up over the long haul.

Collaborative divorce sounds appealing, but it isn't right for everyone. The biggest catch is this: if the process falls apart, both attorneys have to quit. You start over with a new lawyer, which means paying twice and losing months of time. It can also cost more upfront, because the process often brings in extra professionals like a financial expert or a child specialist. And since you never go before a judge, no one can force your spouse to hand over bank records or tell the truth about what they own. That makes collaborative divorce a bad fit when there's been abuse, hidden money, or one spouse holding all the power. There's also no deadline pushing things forward, so a spouse who wants to stall can drag it out.

Attorney Chelsea Hayes graduated from Arizona State University Sandra Day O’Connor College of Law. Before going to law school, Chelsea served in the Air Force. While she loved serving her country, Chelsea wanted to serve her community in a different capacity and decided on a career change. While in the Air Force, Chelsea was a Geospatial and Operations Intelligence Analyst.

Chelsea began her legal career as a Deputy District Attorney at the 4th Judicial District Attorney’s Office. She handled many different criminal cases in the County Court division. Chelsea joined Moran, Allen, & Associates in May 2023, handling family law and criminal matters.

Chelsea grew up right outside Pittsburgh, Pennsylvania, and is an avid Steelers fan. Her husband is still active duty in the Air Force. They have two French Bulldogs named Frank and Buzz. They enjoy hiking, visiting National Parks, and RV camping during their free time.

In a Colorado divorce, money trails matter. If one spouse says certain assets should stay separate instead of getting split up, you need to prove where that money actually came from. That's where tracing comes in—basically, you follow the money through bank accounts, investments, real estate deals, and whatever other financial records exist to figure out its original source. It gets complicated when separate assets get mixed in with money earned during the marriage, or when one spouse has hidden assets, made odd spending decisions, or transferred money around before or during the divorce. If you can document the money's journey and analyze it carefully, you can make a solid case for what's actually yours and make sure the judge has the full picture when dividing everything up.

In Colorado, a child's preferences may be considered in custody cases, but they are only one factor the court evaluates when determining what arrangement is in the child's best interests. Judges look at the child's age and maturity, the relationship with each parent, each parent's ability to meet the child's needs, and other factors that affect the child's well-being. Contrary to popular belief, there is no specific age at which a child gets to decide where they will live. Understanding how Colorado courts weigh a child's voice can help parents make informed decisions and approach custody matters with realistic expectations.
