Quick Legislation Update! Gov. Wes Moore signed into law the Transfer on Death Deed Act.

It becomes effective October 1, 2026. This new estate planning tool allows homeowners to name a beneficiary who will automatically inherit real property upon the owner’s death, helping the property avoid probate. The deed remains revocable during the owner’s lifetime, giving the owner flexibility while simplifying the transfer process for loved ones.

Before rushing to add a TOD deed to your estate plan, remember: avoiding probate is only one piece of the puzzle. A comprehensive estate plan should also consider incapacity planning, creditor protection, tax implications, and your overall family goals.
