A recent USDA recall of approximately 160,000 pounds of raw pork, beef, and goat products highlights the critical role of federal food safety inspections in protecting consumers.

The products, distributed nationwide, were recalled after the USDA determined they had been produced without federal inspection and carried a false mark of inspection. The recall was classified as Class I, the agency’s highest health risk designation.

A jury awarded $10 million in damages in a wrongful death case, only to have the verdict vacated by the trial judge.

The case will be reviewed by the Third District Court of Appeal. The plaintiffs believe the errors made by the trial court will be corrected on appeal, resulting in a reversal of the ruling and a reinstatement of the jury’s verdict.

This case serves as an important reminder that our justice system should be built on the judgment of a jury, who, when properly instructed on the law as set out by the Third District Court Appeal in this case, reached the right result.

A Pulaski County, Arkansas jury has awarded $13.5 million in damages to Jessica Kemp and Israel Valeriano Pena on behalf of their daughter, Sofia Nicole Valeriano, who suffered permanent brain damage and cerebral palsy following complications surrounding her premature birth.

Ratzan Weissman & Boldt Founding Partner Stuart Ratzan and his firm represent the family in their pursuit of justice and accountability. The unanimous jury verdict found Baptist Health Medical Center-Little Rock and two physicians negligent in causing Sofia’s injuries. The jury apportioned 30% of the fault to Baptist Health.

The verdict is intended to help provide for Sofia’s lifelong care, including medical equipment, attendant care, physical and occupational therapy, and future medical interventions.

The case and verdict were recently highlighted in an Arkansas Democrat-Gazette article by reporter John Lynch.
