If you know me, you know I like all types of art. My level of art skills is at the stick figure stage; however, I admire art and the effort artists take in their work. Artist are typically friendly people! My wife has me hooked on Pop Art, which you see through my office. I am still partial to Southwestern Art.

MILITARY DIVORCE WHEN YOUR SPOUSE IS STATIONED OVERSEAS 🌎⚖️

What happens if your spouse is stationed overseas when you file for divorce in Florida?

An overseas military assignment can create additional procedural and practical challenges, but it does not automatically prevent a Florida divorce from moving forward.

📍 WHERE CAN YOU FILE?

Florida jurisdiction depends on the parties’ residency, domicile, and connections to Florida. A service member being stationed overseas does not automatically determine where a divorce must be filed.

📄 SERVICE OF PROCESS

Serving a spouse overseas may require additional considerations. Proper service is critical, particularly if the spouse contests the divorce or other relief is requested.

⏰ MILITARY PROTECTIONS

The Servicemembers Civil Relief Act (SCRA) provides certain protections to active-duty service members and may affect the timing of proceedings or the Court’s ability to enter certain orders.

💰 MILITARY PAY & BENEFITS

A service member’s LES, BAH, special pay, bonuses, TSP, and other compensation may be relevant to child support, alimony, and equitable distribution.

🎖️ MILITARY RETIREMENT

Military retired pay can be a significant issue in divorce. The Uniformed Services Former Spouses’ Protection Act (USFSPA) may apply when determining whether a former spouse has an interest in military retired pay.

👨‍👩‍👧 CHILDREN & TIMESHARING

An overseas assignment can make a traditional timesharing schedule impractical. A parenting plan may need to address deployment, leave, communication, travel, transportation, and extended periods away from the children.

📱 REMOTE COURT PARTICIPATION

Depending on the proceeding and Court procedures, a service member may be able to participate remotely, although advance approval may be required.

THE BOTTOM LINE:

Being stationed overseas can make a Florida military divorce more complicated, but it does not necessarily mean the divorce has to stop.

Thursdays with Mitch 🏢🚧

This non-descript, unpaved parking lot is the site of the former Cocoa City Hall. It is located across from the former Murdock's Restaurant.

Since 2018, there have been plans to put a hotel on this site. Assuming engineering studies properly manage traffic and parking issues, I think this would be a major enhancement to the Village, especially during events and festivals. The current plan calls for a Fairfield Inn & Suites, seven stories, approximately 110 rooms.

Would a hotel like this be a good addition to the Village? What do you think? 💭

💍 Who Gets the Engagement Ring in a Florida Divorce?

One question that comes up in Florida divorce cases is: “Who gets to keep the engagement ring?”

The answer may depend on when and why the ring was given.

Generally, an engagement ring is treated as a conditional gift as it is given in contemplation of marriage. Once the marriage takes place, that condition has generally been satisfied, and the ring may be treated as the recipient spouse’s separate property.

That means an engagement ring does not automatically become a marital asset simply because the parties later divorce.

However, the circumstances surrounding the ring still matter. Important questions can include:

💎 When was the ring purchased?
💎 When was it given?
💎 Was the marriage already taking place or had the parties already married?
💎 Was the ring purchased with marital funds after the marriage?
💎 Was the ring later sold, exchanged, or used to purchase another piece of jewelry?

The same analysis does not necessarily apply to every piece of jewelry acquired during a marriage. How the item was acquired, when it was acquired, and what funds were used can all affect whether it is considered marital or nonmarital property.

💡 Bottom line: Don't assume that an engagement ring automatically has to be divided in a Florida divorce or that every piece of jewelry belongs exclusively to the spouse who possesses it. The specific facts surrounding the property matter.
