⚖️ What Does “Contempt” Mean in a Florida Divorce or Family Law Case? ⚖️

In Florida family law cases, “contempt” does not simply mean someone is upset or being difficult. Contempt occurs when a person willfully fails to comply with a valid court order.

Under Fla. Stat. § 61.14 and Florida family law enforcement procedures, courts have the authority to enforce orders related to:

✔️ Child support
✔️ Alimony
✔️ Timesharing / parenting plans
✔️ Payment of expenses
✔️ Compliance with court-ordered obligations

💡 Common Examples of Contempt:

Failing to pay court-ordered child support
Refusing to follow a parenting schedule
Ignoring court-ordered financial obligations
Repeatedly violating provisions of a final judgment
⚠️ Important:

For a court to find contempt, the violation generally must be:
✔️ Willful
✔️ Intentional
✔️ In violation of a clear court order

If someone truly lacks the ability to comply, that can become an important issue before the Court.

🧠 What Can Happen If Someone Is Found in Contempt?

Depending on the circumstances, the Court may:

Order payment of overdue amounts
Award attorney’s fees
Require makeup timesharing
Impose sanctions
In some cases, order incarceration until compliance occurs
Florida courts take compliance with family court orders seriously because these orders directly impact children, finances, and family stability.

Many people are surprised to learn that Florida is a “no-fault” divorce state.

Under Florida Statute § 61.052, the court generally does not require either spouse to prove wrongdoing in order to obtain a divorce. Unlike years ago, a spouse does not need to prove adultery, cruelty, abandonment, or other misconduct to dissolve a marriage.

Instead, Florida law only requires one of two grounds for dissolution of marriage:
• The marriage is “irretrievably broken,” pursuant to Fla. Stat. § 61.052(1)(a); or
• One party has been adjudicated mentally incapacitated for at least three years, pursuant to Fla. Stat. § 61.052(1)(b).

In most cases, divorces proceed under the “irretrievably broken” standard. This means that if one spouse believes the marriage cannot be repaired, the court can grant the divorce even if the other spouse does not want to end the marriage.

Because Florida is a no-fault state, the court’s primary focus is not why the marriage ended, but rather how legal issues should be resolved. These issues typically include:
• Equitable distribution of assets and debts under Fla. Stat. § 61.075
• Determination of alimony under Fla. Stat. § 61.08
• Parenting plans and time-sharing under Fla. Stat. § 61.13
• Child support obligations under Fla. Stat. § 61.30

That said, marital misconduct may be relevant in limited circumstances. For example, intentional wasting of marital assets may impact equitable distribution, and certain conduct could impact custody and issues involving children.

Every divorce case is unique, and understanding how Florida’s no-fault laws apply to your specific circumstances is important before making legal decisions.

I’ll admit it, I haven’t made it over to Vintage Vault yet, the new speakeasy-themed restaurant in Cocoa Village. The concept alone has my attention, especially with the history behind the building. For those who may not know, the location was originally home to Barnett Bank, which gives it a pretty unique atmosphere and charm.

That said, this spot has seen several restaurants come and go over the years, so I’m curious... has anyone here tried it yet? How’s the food, drinks, service, and overall experience? Any standout menu items?

They’re currently open for both lunch and dinner, and I’d love to hear honest feedback from the community. Supporting local restaurants and small businesses here in matters, especially when owners are investing in unique dining experiences for our area.
