Made up vehicle moving violations:
Unfortunately, many black men have been killed by police officers after being pulled over for some sort of alleged moving violation. Some of the luckier ones are forcibly pulled from their vehicles or forced out at gun point, thrown to the ground and beaten.
Many of these survivors are charged with disorderly conduct, resisting arrest, disobeying a lawful order, and occasionally a legitimate moving violation. Charges of this magnitude generally result in the victim being detained or jailed, where the physical abuse may continue. In this scenario it is of paramount importance for the alleged victim to do everything in their power to spend as little time in detention or jail as possible. Which means you will have to call someone to get you released. Suppose you’re out of town, or even worse in another state. Who do you call, a family member, a friend, or an attorney? The one thing you should not do is threaten to call your lawyer, if you don’t have one. Besides, how many people do you personally know who always have a lawyer on retainer, other than the wealthy?
I know I’m not the only person who knows non-wealthy people who do have a lawyer at their service, without a retainer. Let me explain: there are several legal service companies out there that provides legal services via toll-free number 24/7 as part of their legal plans, that includes a lawyer. These services include motor vehicle coverage for moving violations. Victims with this coverage can place their (1) allowable phone call to their legal service company, and a lawyer will be tasked to handle your situation, regardless of your location. They will also handle all charges placed against you. They will also appear in court with you or for you if the violation is out of state. The real good thing about having such a service is the fact that you can contest the charges in court. Many times, the arresting office does not appear in court, but your lawyer will. Quite often the case is either rescheduled or dismissed if the officer does not appear.
Having this type of legal service does two very important things. First, it demonstrates respect for the legal system, and secondly it gets you released from jail. I know from which I speak because I have had this type of legal coverage for many years, but only had to use it twice. Both times my situation was out of state and I did not need to appear, and no points were assessed either time. I’m not going to claim the company I use is superior to any other, but I’m a proud member of Legal Shield.
