Flannery Georgalis, LLC is pleased to announce the addition of investigator, Cathy Hanselman. Cathy brings to F | G more than 25 years of federal law enforcement experience as a Special Agent with HHS-OIG. While in government, Cathy investigated all manner of complex healthcare fraud cases, including civil and criminal enforcement matters, which led to some of the Northern District of Ohio’s most significant prosecutions and millions of dollars of forfeiture and monetary recovery. During her decades-long career at HHS-OIG, Cathy gained extensive knowledge on healthcare compliance issues, CMS contractors, OIG Corporate Integrity agreements, Anti-Kickback violations, Stark Law, and Civil False Claims Act violations. Cathy also worked on sensitive HHS internal employment investigations, which often involved allegations of assault, theft, sexual misconduct, conflict of interest violations, internal policy violations, or whistleblower reprisal. Cathy’s knowledge and experience expands F | G’s talented roster of former federal special agents who assist in the Firm’s representation of clients. Welcome to the F | G team, Cathy!

Flannery Georgalis, LLC is pleased to announce the addition of Susan Jacobsen as an associate attorney in the firm’s Cleveland office. Susan graduated summa cm laude from Cleveland-Marshall College of Law where she made the Dean’s List and was an Editor on the Cleveland State Law Review. During law school, she was a judicial extern for the Honorable Michael P. Donnelly of the Ohio Supreme Court. Prior to law school, Susan worked as a paralegal for several years at the Cuyahoga County Prosecutor’s office in the Special Investigations Division. Susan was also a personal bailiff for the Honorable Richard A. Bell in the Cuyahoga County Court of Common Pleas where she assisted the Judge with coordinating criminal cases. Prior to joining Flannery | Georgalis, Susan was an associate attorney for an online defamation law firm. Welcome to the F | G team, Susan!

Recently, The U.S. Attorney's Office for the Northern District of Ohio (USAO-NDOH) announced public procedures to report environmental crimes and issues relating to environmental justice. All concerns and issues regarding environmental matters are now available to be reported online to the DOJ USEPA'S website: “Report Environmental Violations.”

The Comprehensive Environmental Justice Strategy provides a guideline for the Justice Department’s civil and criminal enforcement authorities along with other federal partners and the EPA to secure and advance environmental justice through key remedies for violations, contaminations, and injuries to natural resources in underserved communities. The USAO appointed a new Environmental Justice Coordinator to preside and correlate with the ENRD and the EPA to build and enforce the principles and actions to continue to advance environmental justice through the enforcement of federal laws.

Matthew Jalandoni is the former head of an environmental enforcement agency for the Ohio Attorney General's office and focuses his practice on environmental compliance and litigation, having led the Ohio AG’S Environmental Criminal Prosecution Unit. F| G investigator, Carol Paszkiewicz was a special agent for EPA-CID with nearly 24 years of federal law enforcement experience leading complex environmental offenses, healthcare fraud, anti-kickback violations, and public corruption. They both handle complex criminal and civil environmental enforcement matters in the region and throughout the United States and understand the new public procedures and violations.

Recently, Deputy Attorney General Lisa Monaco delivered remarks and issued a memorandum detailing significant revisions to DOJ policy on corporate criminal enforcement. Perhaps the largest takeaway was the DOJ’s desire for forthright corporate cooperation that could aid it in its pursuit of individual bad actors. To that end, DOJ policy will allow for “cooperation credit” when a corporation swiftly provides information on individual misconduct. And, DOJ policy now provides that in the absence of aggravating factors, the DOJ will not seek a guilty plea from a corporation that has “voluntarily self-disclosed, fully cooperated, and timely and appropriately remedied the criminal conduct.”

In essence, the DOJ wants corporations to take a proactive approach to detecting and preventing crime by its officers and employees. Corporations that act proactively and take advantage of this new policy are likely to find themselves in a much a better position than those that take a reactive approach to the DOJ’s criminal investigations. Flannery | Georgalis has long advocated a proactive approach to engaging with federal law enforcement and regulators and has helped a number of corporate and individual clients navigate the proffer and disclosure process. Christos Georgalis and Paul Flannery were formal federal prosecutors a few years ago until they opened their own firm, Flannery Georgalis, LLC. They started in Cleveland, and have expanded into Pittsburgh, Charlotte, and Columbus, with further growth in the works.

Flannery Georgalis, LLC is pleased to announce the addition of Nathan Coyne as an associate attorney in the firm's Columbus office. Nathan earned his J.D., magna cm laude, from The Ohio State University Moritz College of Law, where he was admitted into the Order of the Coif, and was the Executive Article Editor for The Ohio State Journal of Criminal Law, graduating in the top of his class. Following law school, Nathan served as a judicial law clerk to the Honorable Judge Edmund A. Sargus, Jr. in the United States District Court for the Southern District of Ohio, as well as the Honorable Justice Pat DeWine of the Ohio Supreme Court . Along with his extensive background in federal and state court, Nathan had prior experience as a law clerk for the Ohio Attorney General's Office and later received clinical experience working for Senator Kristina Roegner. As the evolving COVID-19 situation is sweeping across the nation and affecting the economy for both local and global companies, the Department of Justice (“DOJ”) and the Federal Trade Commission (“FTC”) are focusing their efforts on bringing down offenders trying to take advantage of a crisis situation.
