“The horseman takes the bench, and they shake in their boots. High cash bonds for everyone is safe to assume.”

With yesterday’s passage of Issue 1, judges are more empowered to impose high cash bonds when they believe “public safety” warrants it. They’ve also delegated judicial review of bond procedures away from the Supreme Court of Ohio.

“Pursuant to division (B) of section 109.803 of the Revised Code, any peace officer or trooper who, in any calendar year, fails to comply with the continuing professional training requirements set forth in rules 109:2-18-01 to 109:2-18-07 of the Administrative Code shall cease carrying a firearm and shall cease performing the functions of a peace officer or trooper until such time as evidence of compliance is filed with the executive director.” Ohio Admin. The exclusionary rule is a judicially created remedy applied to exclude evidence from the government's case in chief when it has been obtained by police through an illegal search or seizure in violation of the Fourth Amendment. Mapp v. Ohio (1961), 367 U.S. 643. The exclusionary rule applies not only to primary evidence directly obtained by police during an illegal search or seizure but also to "derivative evidence," that is, evidence discovered from knowledge gained by the police as a result of the illegal search or seizure. Silverthorne Lumber Co. v. U.S. (1920), 251 U.S. 385.
Derivative evidence is known as "fruit of the poisonous tree." Nardone v. U.S. (1939), 308 U.S. 338.

Even if you only punch someone, you can still be charged with felonious assault, a felony of the second degree, punishable by up to 8-12 years in prison (considering Regan-Tokes). The operative question is whether or not you caused serious harm, or attempted to cause serious harm with a deadly weapon. Contrary to popular notion, hands and feet are generally not considered deadly weapons.

Also note that Aggravated Assault is a lesser offense that is very similar to Felonious Assault. Aggravated Asaault occurs when one commits serious physical harm or attempts to cause physical harm with a weapon, while under serious provocation. A felony of the fourth degree usually is sentenced to probation or a prison term of no more than 18 months in Ohio.

Finally, a misdemeanor assault is any other physical combat which doesn’t involve weapons or serious physical harm. Serious physical harm typically involves fractures, lacerations requiring stitches, internal injuries, concussions, or lead to hospitalization.

Mike Tyson seemed to lose his cool on a plane on Wednesday night ... repeatedly punching a man in the face after the guy had apparently annoyed him.

The truth about diversity in the legal profession and in corporate America is that too often firms and companies look for diverse faces to regurgitate the same messages and antiquated culture. Basically, they look for black and brown faces to validate stagnant white spaces. Nothing really changes. If you want real and authentic representation, call me!

As 4/20 approaches, law enforcement will be on high alert for impaired driving. High and buzzed driving is impaired driving! If a cop says he smells w**d in your car, he will search your vehicle compartments. This often leads to gun and drug charges which could blow your high! Be good or be good at it!
