A dependent adult (an adult that cannot support themself financially and may have a disability) can seek child support from a parent any time after they reach 18 years old. What happens when it has been more than 4 years since that person reached the age of majority (turned 18), and paternity has not yet been established? Can the dependent adult still seek support from the putative father? According to the Fifth DCA Court in Cannon v. Lane, because the statute of limitations for establishing paternity runs out 4 years after a child turns 18, even though support from a parent for a dependent adult may be established at any time, if paternity was not established within 4 years of the age majority, then it may not be later established and, therefore, support against the putative father cannot be ordered.

This is just one more reason establishing "paternity" is so important.

A recent family law case decision by the Fifth District Court of Appeals affirms that if you filed a motion and the family court awards you relief that's NOT in that motion, it is appealable and may be overturned and sent back to the trial court.

Make sure your motions ask for the relief you want and do not be narrow, cast a wide enough net to help yourself get relief.
