An operating agreement is the governing document for your LLC. It spells out:

πŸ“ˆ Insurance Points β€” tracked by your insurance company, affect your rates

Here's the thing: these are NOT the same. A ticket might trigger insurance points even if it doesn't add DMV points, and vice versa.

A prayer for judgment continued (PJC) can sometimes protect you from insurance points, but it can only be used once every three years per household for insurance purposes.

"What's the difference between a guardianship and a power of attorney?"

Great question. Here's the key difference:

πŸ“„ A power of attorney is set up IN ADVANCE by the person β€” while they still have capacity. They choose who acts for them.

βš–οΈ Guardianship is a court process β€” used when someone LACKS capacity and no POA is in place. A judge appoints the guardian.

Guardianship is more expensive, more time-consuming, and takes the decision out of the family's hands.

The takeaway? Get your power of attorney in place while you can. It's one of the most important documents in your estate plan β€” and it can prevent the need for guardianship later.
