Myth or fact…you do not need to document violations - verbal reports are enough.

Although there is no legal requirement to document violations, doing so creates a paper trail that allows us, as your counsel, to substantiate both the violation and the need for enforcement if the matter escalates. The need to document not only applies to reporting violations (when owners or other residents report a violation to management or to the board) but it also applies when putting an owner on notice once a violation is confirmed. In both instances, communications should be in writing!

How we turned a complete coverage denial ($0 offer) into a $10.5 million settlement.

Our condominium client’s property sustained significant damage due to suspected sinkhole activity. When the claim was reported to the property insurance carrier, it was swiftly denied. Despite years of paying substantial insurance premiums, the community was left without coverage when it mattered most.

What followed was over 3.5 years of hard-fought litigation. Ultimately, our client’s commitment and persistence was rewarded in the form of a $10,500,000.00 settlement.

We are deeply grateful to our co-counsel, Erin Dunnavant, and her dedicated team at Danahy & Dunnavant, P.A., as well as the engineers, construction professionals, and contract specialists whose expertise and tireless work helped our client build their case.

Most of all, we are humbled by the trust the Board of Directors placed in our firm throughout this long and challenging process. There is no greater reward than seeing that trust translate into meaningful results, and to watch this community rebuild after years of uncertainty is truly gratifying.
