A new Missouri Court of Appeals Eastern District Opinion issued this week. Stay off the m**h, people!

Parental rights terminated over m**h. Evidence supporting a finding that appellant neglects children included evidence of inadequate housing and consumption of m**hamphetamine in a child’s presence. Evidence supporting a finding that appellant had an untreatable dependency on m**hamphetamine included drug screenings, either skipped or failed; treatment programs incomplete or failed; and multiple relapses in use. That evidence, and evidence of failures to offer financial support while employed and to participate in rehabilitative services, supported a finding that termination of appellant’s parental rights was in children’s best interests.

New appellate opinion issued by the Southern District this week provides that: “When there is no inconvenience to the court or unfair advantage to one of the parties, it is an abuse of discretion for a trial court to refuse to permit the introduction of material evidence which might substantially affect the merits of the case.”

While I generally agree with this principle, I'm concerned that it could open the door to contentious disputes about what is "inconvenient to the court" or "unfair to one of the parties".

New opinion from Missouri Court of Appeals Eastern District provides that when a child is born of a same s*x marriage of two female spouses, both spouses are subject to the presumption of parenthood and have standing seek custody, even though only one spouse actually bore the child.

New opinion from Missouri Court of Appeals Western District provides that an action for declaration of paternity is not the exclusive procedure for determining the parentage of a child born out of wedlock, so the circuit court had jurisdiction and authority to determine child custody and support in a judgment dissolving marriage.
