Hey Now!

I thought I’d drop on by and introduce myself again for anyone new around here.

My name is Tom Carter and I’m obsessed with helping business owners stay out of legal trouble.

So, how did I end up here?

Well, I began my legal career in Washington D.C. in 2008. I eventually made my way back to California working as an Associate Attorney in Claremont.

Later I was employed as a General Counsel to NationalLink, an industry leader located in Glendora, California providing ATM solutions.

In 2014, I launched my own business law practice representing businesses, institutions and individuals with my focus increased in Commercial Litigation, Business Transactions, Contracts, Franchises / Partnerships, Startups and more.

A common theme I noticed with my clients is that many of them were worried about the cost of hiring an attorney when starting their business and didn’t understand the potential impact on their personal finances, assets and wellbeing of their business if they encountered legal troubles.

Most of my clients were unknowingly out of compliance with laws and regulations, which could end up costing them big bucks down the road and could threaten the financial stability of their business.

I realized many issues could have been avoided if business owners understood the main legal pitfalls their company could face and what they can do to protect their enterprise. I love to teach my entrepreneurs how to run their business smarter, better and more efficient by keeping them out of legal trouble.

Outside of business world, I am a husband to my wife of 8 years, a father to 3 young kids, and my favorite spirit is vodka.

Fun fact about me: I worked at the Memphis Zoo when I was in collage.

The one thing your business contract should likely include are

ATTORNEY’S FEES PROVISIONS

If this clause is absent from your contract, when you get sued each party is required to pay for their own attorney’s fees.

If this is included in your contract, and you win the lawsuit, the other party is required to pay your attorney’s fees.

This help ups the ante in such disputes, and can give added pressure tot the other side to do the right thing. This makes it much more worth it for the parties involved to bring only righteous claims.

People are free post negative reviews about your business online, but what they can’t do is falsely defame your business by saying things like:

* “These people are liars and thieves. Head to the hills!”
* “Don’t go here. I was ripped off. They are all a bunch of crooks”
* These people literally destroyed my business. ONE STAR!”

These are actionable in the civil courts as unlawful defamation.

The area in which I see the most lawsuits is in alleged violations of California’s labor laws. These can occur relatively easily if employers are not well-informed or fail to adhere to the requirements.

To avoid violating California’s labor laws, employers should proactively educate themselves about the applicable laws and seek legal guidance if necessary. One should regularly update their policies and practices, maintain accurate records, and provide training to employees and management.
