FDA EARLY ALERT: IMPELLA CONTROLLERS

The FDA has issued an early alert involving certain Abiomed Automated Impella Controllers that may require hardware, firmware or software updates.

The identified issues include possible start-up failure, failure to recognize a purge cassette, unreliable controls and potential loss of console control. These problems could delay therapy or interrupt the circulatory support provided by an Impella catheter.

As of September 8, 2026, Abiomed had reported no serious injuries or deaths associated with the issue.

Abiomed is contacting affected facilities to coordinate removal, updating and return of the controllers. Hospitals may continue using available inventory while awaiting service when necessary to preserve continuity of patient care.

FDA EARLY ALERT: VOCSN VENTILATORS

The FDA has issued an early alert concerning a potentially high-risk issue affecting VOCSN ventilators with serial numbers 112786 and higher.

An internal cable connection may become partially or fully unseated, potentially causing repeated reboots and “System Fault 10” alarms. If a reboot occurs during ventilation, therapy could be interrupted. Ventilator-dependent patients may face a risk of serious injury, permanent impairment or death if backup ventilation is not initiated promptly.

As of August 12, 2026, no serious injuries or deaths—and no reboots during active ventilation—had been reported.

Patients should not discontinue therapy unless appropriate alternative ventilation is available and their treating clinician instructs them to do so. Facilities and caregivers should keep functional backup ventilation immediately available and arrange servicing for devices displaying recurring reboots or alarms.

On This Day in Ohio Law — September 17, 2008

When someone is seriously injured, a spouse may end up becoming a caregiver—sometimes missing work or even leaving a job to provide that care.

In Hutchings v. Childress, the Ohio Supreme Court addressed how those losses are measured.

The Court held that when a spouse provides necessary nursing or caregiving services to an injured spouse, the injured spouse may recover the reasonable value of those services as part of the injured spouse’s damages.

But there’s an important distinction: the measure of recovery is the reasonable value of the care provided—not the caregiving spouse’s lost wages.

That distinction can have real consequences. A family may suffer a substantial financial loss when one spouse stops working to care for the other, but Ohio law does not necessarily measure the recoverable damages by the amount of the caregiver’s paycheck.

The case: Hutchings v. Childress, 119 Ohio St.3d 486, 2008-Ohio-4568, 895 N.E.2d 520.

PRODUCT RECALL ALERT: Hair-Dryer Brushes

The U.S. Consumer Product Safety Commission has announced the recall of approximately 1,738 DHASUWT Hair Dryer and Blow Dryer Brushes, model XR-8801.

The recalled brushes lack a required immersion-protection device, creating a risk of serious injury or death from electrocution or electric shock if they fall into water while plugged in. They also pose smoking and fire hazards.

Ten incidents involving smoking or fire have been reported. No injuries have been reported.

The brushes were sold on Amazon from October 2024 through June 2026. Consumers should unplug and stop using them immediately and follow the CPSC’s instructions to obtain a refund.
