🚨 MAJOR WIN FOR IMMIGRANTS 🚨

A federal judge in Rhode Island just vacated ALL four of the USCIS pause policies — effective today, June 5, 2026!

The court struck down:
❌ The Global Asylum Hold
❌ The Benefits Hold (green cards, work permits, citizenship)
❌ The Comprehensive Re-Review Policy
❌ The Country-Specific Discretionary Factors Policy

The court found that USCIS violated federal law by acting without authority, failing to explain its reasoning, ignoring the harm to applicants, and using national security as a pretext for anti-immigrant policies.

This affects people from 39 countries — including Afghanistan, Haiti, Somalia, Venezuela, Nigeria, and many more — who have been stuck in legal limbo for months despite doing everything right.

📞 If your case has been on hold, call Talamantes Immigration Law Firm today. This ruling may change everything for you.

🚨 BREAKING IMMIGRATION NEWS 🚨

The U.S. Senate voted 52-47 early this morning to pass $70 billion in funding for Immigration and Customs Enforcement and Border Patrol through the remainder of President Trump’s term. The bill now heads to the House, which is not expected to take it up until early next week.

⚠️ Why this matters:

• This legislation would significantly expand resources for immigration enforcement agencies nationwide
• It has not yet become law — it still must pass the House and be signed by the President
• Only one Republican, Sen. Lisa Murkowski of Alaska, voted against it

📋 Also ongoing: USCIS recently issued guidance stating that adjustment of status (green card applications from inside the U.S.) is a discretionary benefit reserved for “extraordinary circumstances,” creating serious uncertainty for applicants with pending I-485 cases. This policy is already facing legal scrutiny and criticism.

Immigration law is changing fast. Do not make decisions about your case without speaking to an attorney first.

The U.S. Supreme Court is expected to issue a decision in the coming weeks on a major case involving birthright citizenship.

Under current law, individuals born in the United States are generally recognized as U.S. citizens under the 14th Amendment. President Trump’s executive order seeks to deny automatic citizenship to certain children born in the U.S. when their parents are undocumented or are in the country on temporary visas.

The Court heard arguments on April 1, 2026, and a decision is expected before the end of the Court’s current term.

This case could have significant implications for families across the country. We are closely monitoring developments and will provide updates as they become available.

🌸 Important USCIS Update for Green Card Applicants 🌸

The immigration landscape continues to change. USCIS recently issued a policy memorandum reminding officers that Adjustment of Status (Form I-485) is a discretionary benefit and directing them to apply a more rigorous review when deciding whether to approve green card applications filed inside the United States. USCIS has indicated that Adjustment of Status should be viewed as an “extraordinary” form of relief and that officers should carefully weigh positive and negative factors in each case.

What does this mean for applicants?

âś… Strong evidence of good moral character, family ties, employment history, community involvement, and compliance with immigration laws may become more important than ever.

âś… Applicants with prior immigration violations, unlawful presence, or other negative factors could face increased scrutiny.

âś… Every case should be prepared thoroughly with supporting documentation to demonstrate why favorable discretion is warranted.

While Adjustment of Status remains available under the law, this policy shift highlights the importance of filing a well-prepared application and understanding how these changes may affect your case.

If you have questions about your pending green card application or are considering filing for Adjustment of Status, contact Talamantes Immigration Law Firm, APC for a case evaluation.

🚨 The Trump admin just tried to walk back its own green card policy — and it’s still a mess.

Last week, USCIS issued a memo declaring that Adjustment of Status (AOS) — applying for your green card without leaving the U.S. — is now “extraordinary relief” reserved for special cases only. The NY Times called it: “Green Card Seekers Must Leave U.S. to Apply.”

The backlash was immediate. Now DHS is scrambling to downplay it — but former officials say this isn’t a retreat. It’s a reframe.

The memo is still in effect. Meeting basic requirements like a valid marriage or approved petition is no longer a guarantee of approval. Officers have more power to deny your case than ever before.

If you have a pending AOS application or were about to file — call us NOW. The rules are changing in real time.

Federal Court Restores Critical Protections for Crime Victims

On May 20, 2026, a federal court issued a nationwide preliminary injunction in Immigration Center for Women and Children v. Noem, halting a restrictive policy that authorized routine arrest and removal of noncitizens with pending VAWA, U-visa, and T-visa petitions.

What This Means for Our Clients

This decision restores a victim-centered approach to immigration enforcement. Noncitizen crime survivors can now cooperate with law enforcement without fear of immediate deportation. The court’s order protects an estimated 600,000 people currently awaiting adjudication of their protective visas.

Our Next Steps

If you have a pending U-visa, T-visa, or VAWA application, this decision significantly strengthens your position. We’re reviewing cases where clients were previously removed under the challenged policy and exploring options for their return to the United States.

What You Should Do

If you or someone you know is a crime victim with a pending petition, don’t delay. Contact our office to discuss how this decision affects your case and what protections now apply to you.

While this is a significant victory, the case will continue through the courts. We remain committed to defending your rights and keeping you informed of developments.
