And yesterday, Chris Langone of LJC won an important precedent in the area of the TCPA -- in denying summary judgment to EngageTel, the Court held" (1) companies that facilitate spoofing can, depending on the facts, give rise to direct liability under the TCPA for being "so involved in the call as to be deemed to have made it;" and (2) the diminished value of call-blocking phones can count as actual pecuniary damages under the Illinois Consumer Fraud Act, providing standing and allowing for the other intangible damages.
