This will help to correct the delayed justice felt by so many people who are injured by the actions of others. Requiring insurance companies to pay pre-judgment interest removes the incentive for them to delay paying on valid claims, giving the victims of negligence the compensation they deserve, when they need it. It’s a win for the people of Illinois.

ITLA President Larry Rogers, Jr. testified in the IL Senate on HB 3360 Monday, January 11, 2021. This bill passed both the IL House and Senate. If signed by the governor, defendants and insurers will no longer benefit from delaying resolution of meritorious injury cases.

This is a clause buried in the fine print of most credit card, cell phone, online "terms of use" agreements, employment, nursing home admission forms, Amtrak tickets, E-Scooter contracts, ride-sharing apps, and many other everyday contracts. It means that if the company cheats, defrauds, discriminates against you, or negligently causes your physical injuries, you cannot sue the company in court or have a jury trial. Instead, you are forced to resolve your dispute is a private, secretive, rigged arbitration system controlled by the company. You may have to pay for the arbitrator. And there is no right to appeal.
