Spousal maintenance is about more than a simple formula. Before any award is made, the court carefully reviews the unique facts of each case, including income, assets, earning capacity, and other relevant factors.

In Illinois, the general guideline for calculating maintenance is:

33% of the payer's net income − 25% of the recipient's net income = yearly maintenance payment

The court will then review the calculation to determine whether adjustments are necessary based on the circumstances of the case. Additionally, maintenance cannot result in one spouse receiving more than 40% of the couple's combined income.
