Attempted Murder Charges Dismissed!
A few months ago, I met my client in central booking. We only had a few minutes to chat before he was going to be arraigned on attempted murder charges stemming from a vicious stabbing that happened outside a nightclub around 2am. Throughout our conversation, he repeatedly told me he that did not do this, that he was at home in his bed asleep when the stabbing occurred. I believed him. Unfortunately, the arraignment judge did not. The judge remanded into the custody of New York City’s Department of Corrections and bused to Riker’s Island where he would live as the case worked its way through the system.
That is, if something did not change. And that is the power great lawyers have. A great lawyer can change lives. A great lawyer can save lives. Every day I wake up, I intend on being a great lawyer.
The day after his arraignment, I drafted and personally served a subpoena for the surveillance video at his apartment complex. It was a TON a video: More than 48 hours of video, recorded by 10 cameras stationed at all 3 of the building’s exits, multiple hallways leading to those exits, and in both elevators. I immediately got to work and started reviewing the footage.
Sure enough, the videos showed my client walking into his apartment building around 6pm. And sure enough, the videos showed my client walking out of the building a little after 5am the next day. His alibi checked out. He was innocent! And yet, he was sitting in a cell on Rikers Island. There was more work to be done.
I contacted the District Attorney’s office and set up a meeting. Though it took their office sometime and required me to follow up on a couple occasions, the DAs office ultimately did the right thing: they agreed to dismiss the charges. 4 months after I told him in central booking that if convicted he would be looking at spending the rest of his life in prison, today I walked my client out of the Kings County Supreme Courthouse, a free man.
