The Illinois federal court recently ruled on behalf of the City of Chicago on almost all of an insurer's attempts to recoup over $26 million in payments it made to the Sears Tower arising out of flood damages from a 2020 rainstorm. Travelers Insurance argued that the massive flooding and damage was due to the City's undersized sewer and stormwater system and “delayed opening downstream locks and gates” to reduce water levels." In ruling against the insurer, the Court noted that official government data disproved Travelers’ allegations in its pleadings. The case will proceed on the common law negligence counts only.
