Espinoza prevails at the Seventh Circuit in a precedential decision which holds that: (1)Immigration Judges have a mandatory duty to advise non-citizens of the availability of asylum or withholding of removal when they express fear of persecution or harm; and (2) Judge's failure to advise entitles the non-citizen to a new hearing.
