Not legally. Even though you own the property, tenants have privacy rights.

In Chicago, landlords must:
✅ Provide at least 48 hours’ written notice
✅ Enter only for valid reasons (repairs, inspections, showings, emergencies)
✅ Respect tenant boundaries — or risk legal trouble

📝Chicago Residential Landlords: Do you have a proper lease?

Chicago lease terms are highly regulated and the ordinance contains harsh penalties against landlords for non-compliance. Regulations include:

1️⃣ Late Fee Cap

Owners cannot charge a late fee over the max amount allowed by the city ordinance.

The calculation for the max late fee penalty is $10 for up to the first $500 in rent, plus 05% of the balance in rent.

Example for a late fee on $1,000 rent: $10 for the first $500. $1,000 - $500 = $500 x .05 = $25. $10 + $25 = $35 max late fee on $1,000 rent.
2️⃣ Maintenance Responsibilities

The landlord has a responsibility to maintain the premises.

The landlord cannot terminate utility services in retaliation for non-payment of rent.

3️⃣ Entry & Notice Requirements

Must provide at least 48 hour’s notice before gaining access to the leased premises.
No advance notice required for emergency repairs but notice must be provided within 24hrs after access.

⚖️ NEW LAWS ILLINOIS LANDLORDS MUST KNOW IN 2025 🏙️

Big changes are here, and if you’re a landlord in Illinois, staying informed isn’t optional. Here are 5 key laws that took effect in 2025:

1. Flood Risk Disclosure
You must now disclose if your property is in a floodplain or has a history of flooding—especially for basement or garden units.
2. Rent Payment Options
You can no longer require electronic-only rent payments. Tenants must have the option to pay by check or cash.
3. Skip the Sheriff for Service of Process in Eviction Cases
For eviction filings, you can now hire a special process server right away to serve summons on your tenant.
4. Retaliation Protections
Stronger rules now protect tenants who report issues or join tenant unions—you can’t retaliate with eviction or service cuts.
5. Interest on Chicago Security Deposits
The 2025 interest rate for Chicago security deposits is now set at 0.01%—don’t forget to pay or credit interest on security deposits!
