Several of us from Growip Law Group LLC recently had the opportunity to compete in this year’s Patent Cup sailing regatta in Sydney, Australia. This 32nd iteration was organized by Peter Treloar of Spruson & Ferguson and stayed true to the Patent Cup’s motto of “Sailing, Friendship, and Fun.” We enjoyed seeing our friends and colleagues in a remarkable sailing venue and look forward to future years! GrowIP Co-Founder Marcus Thymian organized and led a team in this year’s 31st annual Patent Cup regatta in Chicago last week. The event pits teams of patent professionals from around the world against one another in a friendly sailing competition. The Patent Cup regatta was created in 1989 by two friends, German patent attorney Peter Franck and French patent attorney Frederic Benech. Franck and Benech conceived of the idea to have a sailing patent attorney or agent organize in his or her own country a friendly race among patent professionals to showcase local sailing venues that might otherwise not be discovered. This year’s races were sailed on the Chicago Yacht Club’s fleet of “Tom 28” boats and included sailors from 9 different countries. GrowIP was a proud sponsor of this year’s event, which was sailed in perfect weather – never a guarantee for Chicago in September!

GrowIP Wins Federal Circuit Appeal for Ethika, Inc.:
In Judge Cunningham’s first opinion since being appointed, GrowIP’s client Ethika, Inc. was victorious, as the court last week affirmed the cancellation of appellant’s “ETHIK CLOTHING CO.” trademark registration. The 2021 Biden nominee wrote that the USPTO’s Trademark Trial and Appeal Board “properly gave little weight to the descriptive term CLOTHING CO.” and “also properly afforded less weight to the design component of the mark.” The unanimous court found no error in other aspects of the Board’s likelihood-of-confusion analysis and further dispensed with appellant’s additional new arguments made for first time on appeal. GrowIP Co-Founder Kirsten Thomson led Ethika’s efforts at the Federal Circuit and the Trademark Trial and Appeal Board, with assistance from Andrea Orth and other members of the GrowIP team.
